If two hadith conflict with each other and both are being used as evidence for two opposing rulings, then one hadith will not be chosen over the other because one is in Bukhari or Muslim and the other not. There must be clear proof for choosing one hadith over another. Ibn Humóm writes in Fatú al-Bari, “One hadith will not be preferred over the other because it is a hadith of Bukhari.”42 What fault is it of the other hadith that Imam Bukhari didn’t include it in his book?
