Si dos hadices se contradicen entre sí y ambos se usan como evidencia para dos dictámenes opuestos, no se preferirá uno sobre el otro por el simple hecho de que uno esté en Bujari o Muslim y el otro no. Debe haber una prueba clara para preferir un hadiz sobre otro. Ibn Humám escribe en Fatḥ al-Bari: “No se preferirá un hadiz sobre otro porque sea un hadiz de Bujari.”42 ¿Qué falta tiene el otro hadiz por no haberlo incluido el Imam Bujari en su libro?

If two hadith conflict with each other and both are being used as evidence for two opposing rulings, then one hadith will not be chosen over the other because one is in Bukhari or Muslim and the other not. There must be clear proof for choosing one hadith over another. Ibn Humóm writes in Fatú al-Bari, “One hadith will not be preferred over the other because it is a hadith of Bukhari.”42 What fault is it of the other hadith that Imam Bukhari didn’t include it in his book?
