もし二つのハディースが互いに矛盾し、両方が対立する二つの判断の根拠として用いられている場合、一方がブハーリーやムスリムに収録されており、他方がそうでないという理由だけで、一方が他方より優先されることはありません。一方を選ぶには明確な証拠が必要です。イブン・フマームはファトフ・アル＝バーリーの中でこう書いています。「一方のハディースが、ブハーリーのハディースであるという理由で、他方より優先されることはない。」42 もう一方のハディースが、イマーム・ブハーリーがその書に収録しなかったことによって、いったいどのような欠点を負うというのでしょうか。

If two hadith conflict with each other and both are being used as evidence for two opposing rulings, then one hadith will not be chosen over the other because one is in Bukhari or Muslim and the other not. There must be clear proof for choosing one hadith over another. Ibn Humóm writes in Fatú al-Bari, “One hadith will not be preferred over the other because it is a hadith of Bukhari.”42 What fault is it of the other hadith that Imam Bukhari didn’t include it in his book?
