Si deux hadiths se contredisent et que les deux sont utilisés comme preuves pour deux avis opposés, on ne préférera pas un hadith à l'autre parce que l'un figure dans Bukhari ou Muslim et l'autre non. Il faut une preuve claire pour choisir un hadith plutôt qu'un autre. Ibn Humam écrit dans Fath al-Bari : « Un hadith ne sera pas préféré à un autre parce qu'il est un hadith de Bukhari. »42 Quelle faute a donc l'autre hadith de ce que l'imam Bukhari ne l'a pas inclus dans son livre ?

If two hadith conflict with each other and both are being used as evidence for two opposing rulings, then one hadith will not be chosen over the other because one is in Bukhari or Muslim and the other not. There must be clear proof for choosing one hadith over another. Ibn Humóm writes in Fatú al-Bari, “One hadith will not be preferred over the other because it is a hadith of Bukhari.”42 What fault is it of the other hadith that Imam Bukhari didn’t include it in his book?
