Artigo 41.

Article 41.

O Califa nomeia um assistente delegado com a autoridade para auxiliá-lo no exercício da responsabilidade de governar. Ele delega a esse assistente a gestão dos assuntos segundo o seu próprio ponto de vista e ijtihad.

The Khaleefah appoints an assistant delegated with the authority to assist him in undertaking the responsibility of ruling. He deputises to him to manage affairs with his own point of view and ijtihad.

Artigo 42.

Article 42.

O assistente delegado deve possuir as mesmas qualificações essenciais do Khaleefah, a saber: ser do sexo masculino, livre, muçulmano, maduro, são de mente e 'adl (confiável). Além disso, deve ser competente nas tarefas para as quais foi designado.

The delegated assistant must be qualified with the same essential qualifications of the Khaleefah, viz., male, free, Muslim mature, sane, and 'adl (trustworthy). Additionally he must be competent in the tasks for which he is deputised to undertake.

Artigo 43.

Article 43.

A nomeação do assistente delegado deve implicar tanto a delegação quanto uma responsabilidade geral. Assim, na nomeação do assistente, o Khaleefah deve pronunciar uma declaração no sentido de "Nomeio-te em meu nome como meu substituto", ou qualquer outra declaração que confira tanto a delegação quanto a responsabilidade geral. A menos que o assistente delegado seja nomeado desta maneira, ele não será um assistente delegado nem terá a autoridade de um assistente delegado.

The appointment of the delegated assistant must entail both deputation and a general responsibility. Thus, in the appointment of the assistant, the Khaleefah must pronounce a statement to the effect of "I appoint you on my behalf as my deputy" or any other statement that confers both deputation and general responsibility. Unless the delegated assistant is appointed in this manner he would not be a delegated assistant nor hold the authority of a delegated assistant.

A função do assistente delegado, para distingui-lo do Califa em sua autoridade, é informar o Califa sobre os assuntos que administrou e as nomeações e funções delegadas que executou. Portanto, a função do assistente delegado é informar o Califa de sua análise e, a menos que o Califa o impeça, executá-la.

The function of the delegated assistant, so as to distinguish between him and the Khaleefah in his authority, is to inform the Khaleefah of the matters he has managed and the appointments and delegated duties he has implemented. Therefore, the function of the delegated assistant is to inform the Khaleefah of his analysis and, unless the Khaleefah prevents him, to carry it out.

Artigo 45.

Article 45.

O Califa deve examinar as ações e disposições do auxiliar delegado, a fim de confirmar o que é correto e corrigir o que está errado. Isso porque a gestão dos assuntos da ummah está confiada ao Califa e sujeita ao seu próprio ijtihad.

The Khaleefah has to examine the actions and dispositions of the delegated assistant so as to confirm what is sound and to adjust that which is wrong. This is because the management of the ummah's affairs is entrusted to the Khaleefah and subject to his own ijtihad.

Artigo 46.

Article 46.

Uma vez que o assistente delegado tenha gerido um assunto com a concordância do Khaleefah, ele tem o direito de o executar - como reconhecido - sem qualquer alteração. Se o Khaleefah revisar o assunto e se opuser ao que o assistente delegado executou, aplicam-se as seguintes considerações: Se o Khaleefah se tiver oposto ao que o assistente delegado realizou em relação a uma norma implementada corretamente, ou a um fundo gasto de forma justa, então o parecer do assistente delegado deve ser aplicado. Isto porque, originalmente, é o parecer do Khaleefah, e o Khaleefah não deve reverter leis que ele próprio implementou nem fundos que ele próprio gastou. No entanto, se o assistente delegado tiver implementado outra coisa, como a nomeação de um wali ou o equipamento do exército, então o Khaleefah tem o direito de se opor e de anular a decisão do assistente delegado. Isto porque o Khaleefah tem o direito de reverter as suas próprias decisões nesses casos e, por conseguinte, as do assistente delegado.

Once the delegated assistant has managed a matter with the agreement of the Khaleefah, he has the right to carry it out - as acknowledged - without any alteration. If the Khaleefah revises the matter and objects to what the delegated assistant has executed, the following considerations apply: If the Khaleefah has objected to what the delegated assistant has carried out in regard to a rule implemented soundly, or a fund spent justly, then the view of the delegated assistant must be enacted. This is because it is originally the view of the Khaleefah and the Khaleefah must not redress laws that he has implemented and funds that he has spent. However if the delegated assistant has implemented something else, such as the appointment of a wali or the equipping of the army, then the Khaleefah has the right to object and to overrule the decision of the delegated assistant. This is because the Khaleefah has the right to redress his own decisions in such cases and hence those of the delegated assistant.

Artigo 47.

Article 47.

O assistente delegado possui uma delegação geral e, portanto, não deve ser designado para departamentos específicos nem para tipos específicos de ação. Ele assume a supervisão geral do sistema administrativo, mas não assume os assuntos administrativos.

The delegated assistant has a general deputation and therefore he must not be assigned to specific departments or specific types of action. He undertakes general supervision of the administrative system but not undertakes administrative matters.
