न्यायपालिका का दायित्व है कि वह फ़ैसला सुनाए, ताकि उसे लागू किया जा सके। वह लोगों के बीच के विवादों का निपटारा करती है, उन बातों को रोकती है जो समुदाय के अधिकारों को हानि पहुँचा सकती हैं, और लोगों तथा शासन-व्यवस्था के किसी भी सदस्य के बीच के विवादों का भी निपटारा करती है, चाहे वे शासक हों या सिविल सेवक, ख़लीफ़ा हों या कोई और व्यक्ति।

The Judiciary is responsible for delivering the verdict for the purpose of enforcing it. It settles disputes between people, prevents whatever may harm the rights of the community and also settles the disputes between people and any person who is part of the ruling system, whether they are rulers or civil servants, the Khalifah or any other person. .

न्यायिक व्यवस्था की उत्पत्ति और उसकी वैधता का आधार किताब (क़ुरआन) और सुन्नत हैं। जहाँ तक किताब की बात है, अल्लाह (S.W.T) फ़रमाता है: .

The origins of the judicial system and its validity are the Book and the Sunnah. As for the Book, Allah (S.W.T) says: .

"और उनके बीच उसी के अनुसार फ़ैसला करो जो अल्लाह ने उतारा है।" [5:49]
