تفویض کردہ معاون کو ان شرائط پر پورا اترنا چاہیے جو خلیفہ کے عہدے کے لیے ضروری ہیں، یعنی مرد، آزاد، مسلمان، بالغ، عاقل اور عادل ہونا۔ اس کے علاوہ، معاون کو ان فرائض کے حوالے سے اہلیت رکھنے والے لوگوں میں سے ہونا چاہیے جو اسے سونپے گئے ہیں۔

The delegated assistant should meet the conditions as those required for the Khalifah’s post, i.e. to be male, free, Muslim, mature, sane and just. In addition to this, the assistant should be from the people of competence in what is assigned to him in terms of duties delegated to him. .

ان شرائط کے دلائل وہی ہیں جو خلیفہ کے بعد کے عہد کے شرائط کے ہیں، کیونکہ تفویض کردہ معاون کا کام بھی حکمرانی کا حصہ ہے؛ لہٰذا اس کا مرد ہونا ضروری ہے، کیونکہ رسول اللہ ﷺ نے فرمایا: ۔

Evidences of these conditions are the same as those of the conditions of the Khalifah post because the work of the delegated assistant is part of ruling; therefore he should be male, for the Messenger of Allah (PBUH) said: .

”وہ لوگ کبھی کامیاب نہیں ہوں گے جو کسی عورت کو اپنا حاکم مقرر کریں،“ اسے البخاری نے ابوبکر رضی اللہ عنہ سے روایت کیا ہے۔ [Bukhari, Sahih. #4425]۔ اسے آزاد بھی ہونا چاہیے، کیونکہ غلام اپنے معاملات پر اختیار نہیں رکھتا، لہٰذا وہ دوسرے لوگوں کے معاملات نہیں چلا سکتا۔ اسے بالغ بھی ہونا چاہیے، کیونکہ رسول اللہ ﷺ نے فرمایا ہے: ۔

“People who appoint a woman to run their affairs shall never succeed,” narrated by al-Bukhari on the authority of Abu Bakr. [Bukhari, Sahih. #4425]. He must also be free, for the slave does not have authority over his own affairs, thus he cannot run other people’s affairs. He should also be mature, for the Messenger of Allah (S.W.T) said: .

"تین قسم کے لوگ احتساب سے مستثنیٰ ہیں: سویا ہوا شخص جب تک وہ جاگ نہ جائے، بچہ جب تک وہ بلوغت کی عمر کو نہ پہنچ جائے اور مجنون (پاگل) جب تک وہ تندرست نہ ہو جائے،" اسے ابو داؤد [Sunan, #4358] نے روایت کیا ہے۔ اسے عاقل بھی ہونا چاہیے؛ کیونکہ اسی حدیث میں رسول اللہ ﷺ نے فرمایا: "اور مجنون جب تک وہ تندرست نہ ہو جائے۔"

“Three types of people are exempted from accountability, the one who sleeps until he wakes up, a child until he reaches the age of puberty and the insane until he is cured,” narrated by Abu Dawud [Sunan, #4358]. He also should be sane; for in the same Hadith, the Messenger of Allah (PBUH) said: “And the insane until he is cured.” .

اور ایک دوسری روایت میں حدیث بیان کرتی ہے کہ: '...اس شخص کے بارے میں جس کا ذہن قابو سے باہر ہو جائے یہاں تک کہ وہ ہوش میں نہ آ جائے۔'

And in another narration the Hadith States: ‘…about the one whose mind is overpowered until he regains his mind.’.

معاون کو بھی عادل ہونا چاہیے، کیونکہ اللہ (سبحانہ و تعالیٰ) نے گواہی میں اسے ایک شرط قرار دیا ہے۔

The Mu’awin should also be just, for Allah (S.W.T) has made it a condition in a testimony. .

آپ ﷺ فرماتے ہیں: "اور تم میں سے دو عادل مردوں کو گواہ بناؤ" - [TMQ; 65:2]۔

He (PBUH) says:. “And seek the witness of two just men from amongst you” - [TMQ; 65:2] .

زیادہ گہری دلیل سے، خلیفہ کے معاون سے عدل و انصاف کی صفت کا تقاضا کیا جاتا ہے۔ معاون کو حکمرانی کے فرائض میں بھی اہل اور باصلاحیت ہونا چاہیے۔ یہ اس لیے ہے تاکہ وہ خلیفہ ﷺ کی خلافت کے کاموں اور حکمرانی و اقتدار کی ذمہ داریوں کو اٹھانے میں ان کا مددگار بن سکے۔

By greater reasoning the quality of being just is required from the assistant of the Khalifah. The Mu’awin should also be from the competent people in the duties of ruling. This is so as to enable him to assist the Khalifah in shouldering the tasks of the Khilafah and the responsibility of rule and authority.
