النظام الإداري أسلوبٌ يُتَّبَع لإنجاز مهمةٍ، وهو أيضًا وسيلةٌ من وسائلها، فلا يحتاج إلى دليلٍ خاصٍّ به، بل يكفي أن يكون له دليلٌ عامٌّ يدلّ على أصله. ويكون من الخطأ القول بأن هذه الأساليب أفعالٌ بشريةٌ يجب أن تُمارَس وفق الأحكام الشرعية، وذلك لأن الدليل على هذه الأفعال قد ورد بصيغةٍ عامةٍ فيما يتعلق بأصلها، فيشمل جميع الأفعال المتفرعة عن ذلك الأصل، إلا إذا وُجد دليلٌ شرعيٌّ خاصٌّ يتعلق بفعلٍ فرعيٍّ، فيجب حينئذٍ أن يتبع الفعلُ ذلك الدليل. فمثال ذلك قولُ الله سبحانه وتعالى: ﴿وَآتُوا الزَّكَاةَ﴾. ...وهو دليل عام. ثم جاءت الأدلة في الأفعال الفرعية المتفرعة عنه، مثل مقدار النصاب، والعاملين على الزكاة، وأصناف الأموال التي تُؤخذ منها الزكاة. وكل هذه أفعال مستنبطة من قوله تعالى: {وَآتُوا الزَّكَاةَ}. ولا توجد أدلة تبيّن الكيفية التي يجب على العاملين على الزكاة أن يجبوا بها الزكاة. فهل يذهبون راكبين أم ماشين؟ وهل يستأجرون موظفين آخرين يساعدونهم أم لا؟ وهل يجب عليهم إنشاء مقرّ يجتمعون فيه؟ وهل يكون لهم مستودعات يخزّنون فيها كل ما جمعوه؟ وهل تكون هذه المستودعات تحت الأرض أم تُبنى كبيوت الحبوب؟ وهل تُجمع زكاة النقود في أكياس أم في صناديق؟ كل هذه الأفعال وأمثالها هي في الحقيقة أفعال فرعية نشأت من قوله تعالى: {وَآتُوا الزَّكَاةَ}. فالدليل العام يشملها جميعًا، إذ لا توجد أدلة خاصة بها، وهذا هو حال جميع الأساليب. وبذلك يكون الأسلوب فعلًا فرعيًا عن فعل، أي عن الأصل الذي له دليل عام. ولذلك فإن الأسلوب لا يحتاج إلى دليل، لأن دليل أصله يكون دليلًا له أيضًا.

أما إقامة الإدارة، أي إقامة من يتولّون شؤون الرعية في كل مرفق يحتاج إلى عمل إداري، فهذا يُعدّ من الأفعال الأصلية لا التبعية؛ ولذلك يحتاج إلى دليل. ودليله مستنبط من أفعال رسول الله ﷺ، إذ كان ﷺ يقوم بالحكم والإدارة، فبلّغ الرسالة، ونفّذها، وقام بشؤون المسلمين. أما التبليغ فمعلوم. وأما التنفيذ، فقد جاء الوحي يأمره بجباية الصدقة، وقطع يد السارق، ورجم الزاني، وجلد القاذف، وقتل العدو، وكلها أفعال تنفيذية. وكان ﷺ يكسر الأصنام بيده، وهذا تنفيذ، ويرسل من يزيلها. وكان ﷺ يقتل في ساحة القتال، ويأخذ أسرى الحرب، ويأمر الناس بالعدل ويقيمه، ويعاقب كل صنوف الظالمين والمتمردين، ويأمر الناس بالالتزام بكل ما جاءهم به. وكل ذلك من التنفيذ.

As for the establishment of the administration, i.e. the establishment of those who would manage the citizens’ interests in every utility that needs an administrative work, this would be categorised as an original action and not a subsidiary one; hence it requires evidence. Its evidence is deduced from the actions of the Messenger of Allah (pbuh) as He (pbuh) used to perform the ruling and the administration. He (pbuh) conveyed the message, executed it and discharged the Muslims’ affairs. With regards to the Tableegh (conveying) this is well known. With regards to the execution, the revelation came and ordered Him to collect the Sadaqah, to cut the hand of the thief, to stone the adulterer, to lash the slanderer and to kill the enemy; all of which are executive actions. He used to destroy the idols by his own hand, which is execution, and He would also send people to remove them. He (pbuh) would kill in the battlefield and take prisoners of war, order people to observe justice and established it. He would punish all the various wrongdoers and rebels and order people to adhere to all that He brought to them. All of this is execution.

أما عن دوره في إدارة الشؤون، فقد أنشأ ﷺ نظامًا إداريًا للدوائر المختلفة، وعيّن كتّابًا يتولّون إدارة تلك الدوائر. وكان ﷺ يدير شؤون الناس في المدينة، وعيّن كتّابًا يعينونه في إدارة الدوائر المختلفة. وكان علي بن أبي طالب كاتب العهود والمعاهدات، وكانت هذه وظيفة إدارية لا منصبَ حكم. وكان المُعَيْقِيب بن أبي فاطمة مسؤولًا عن خاتمه الرسمي، وهي وظيفة إدارية لا منصبَ حكم. وروى البخاري في التاريخ عن محمد بن بشار عن جده المُعَيْقيب قال: «كان خاتم رسول الله ﷺ من حديد ملوّى بفضة، وكان عندي، وكان المُعَيْقيب على خاتم رسول الله ﷺ». وكان المُعَيْقيب بن أبي فاطمة أيضًا كاتبًا مسؤولًا عن الغنائم والأسلاب. وكان حذيفة بن اليمان جابيَ ثمار الحجاز، وكان عبد الله بن أرقم كاتبَ القبائل ومياهها وما شابه ذلك. وهذا كله دليل على أن رسول الله ﷺ كان يدير الإدارة إلى جانب قيامه بدوره حاكمًا. غير أنه ﷺ كان قد حدّد لكل واحد من أولئك المديرين نوعَ المهمة التي عيّنه لأدائها، كتسجيل الغنائم والأسلاب، أو تقدير الثمار المفروضة وجبايتها أو نحو ذلك. ولم يحدد ﷺ الأفعال الفرعية التي يتبعها المديرون لإنجاز مهامهم. وهذا الترك للتحديد يعني أن تلك الأفعال فروع عن الأصل، ولذلك كان الأشخاص المكلّفون بتنفيذ تلك المهام أحرارًا في اختيار أي أساليب يرونها لإنجاز المهام الموكولة إليهم وتحقيق المصالح على أكمل وجه.

As for his role in managing the affairs, He (pbuh) established a system of administration for the various departments and appointed secretaries to run those departments. He (pbuh) used to run people’s affairs in Madinah and He appointed secretaries to assist Him with the running of the various departments. Ali Ibnu Abi Talib used to be the notary of the oaths and treaties, which was an administrative duty and not a ruling post. Al Mu’ayqib ibnu Abi Fatima was in charge of his official stamp, an administrative duty and not a ruling post. Al-Bukhari reported in the history from Muhammad bin Bashaar from his grandfather Mu’ayqib, who said; “The stamp of the Messenger of Allah (pbuh) was made of iron covered with silver and it was with me (in my hand). Mu’ayqib was responsible for the stamp of the Messenger of Allah (pbuh).” Mu’ayqib Ibnu Abi Fatima was also the secretary in charge of the spoils and booty. Huzayfah Ibnul-Yaman was the collector of fruit levies of Hijaz, and ‘Abdullah Ibnu Arqam was the registrar of tribes and their waters and so on. All this serves as evidence that the Messenger of Allah (pbuh) ran the administration in addition to carrying out his role as a ruler. However, He (pbuh) had determined for each one of those directors the type of task He had appointed them to do, such as recording the spoils and booty, or the assessment and collection of fruit levies or the like. He (pbuh) however, did not specify the subsidiary actions, which the directors would follow to accomplish their tasks. This non-specification meant that those actions are subsidiaries of the origin. Therefore, those people ordered to carry out those tasks would have been free to choose any styles they wished in order to accomplish the tasks assigned to them and discharge the interests in the most effective way.
