O Muhtasib é o juiz que trata de todos os casos que concernem aos direitos coletivos e que não têm um demandante, desde que esses casos não recaiam sob o código penal (Hudud) e as leis criminais (Jinayat).

Esta é a definição do juiz de Hisbah, que é uma definição deduzida do hadith relativo ao monte de alimento. O Mensageiro de Allah ﷺ descobriu umidade no monte de alimento, por isso ordenou que o alimento úmido fosse exposto no topo para que as pessoas pudessem vê-lo. Este era, portanto, um direito público sobre o qual o Mensageiro de Allah ﷺ fez uma verificação e julgou que o alimento molhado deveria ser exposto no topo para prevenir a fraude. Isto se aplica a todos os direitos ou interesses públicos que são dessa natureza. Não inclui o código penal ou o direito criminal, pois estes não são da mesma espécie, já que são, em primeiro lugar, disputas entre pessoas.

This is the definition of the judge of Hisbah, which is a definition deduced from the hadith relating to the heap of food.
