10.3 The Khaleefah should make enquiries about the works of the governors

خلیفہ کو ولی کے اعمال کے بارے میں دریافت کرنا چاہیے اور اسے ان کی کڑی نگرانی کرنی چاہیے۔ اسے کسی ایسے شخص کو مقرر کرنا چاہیے جو ان کے حالات و احوال کی جانچ پڑتال کر سکے اور معائنہ کر سکے۔ خلیفہ کو چاہیے کہ وہ وقتاً فوقتاً ان سب سے یا ان میں سے بعض سے ملاقات کرے اور رعایا کی ان کے خلاف شکایات سنے۔

The Khaleefah should inquire about the actions of the Waali and He should monitor them closely. He should appoint someone, who can check their state of affairs and carry out inspections. The Khaleefah should also meet with all of them or some of them from time to time and listen to the complaints of the subjects against them.

یہ اس بات سے ثابت ہے کہ رسول اللہ ﷺ ولات (گورنروں) کو مقرر کرتے وقت ان کا امتحان لیا کرتے تھے، جیسا کہ آپ ﷺ نے معاذ اور ابو موسیٰ کے ساتھ لیا۔ آپ ﷺ انہیں ان کے فرائض کی ادائیگی کا طریقہ سمجھایا کرتے تھے، جیسا کہ آپ ﷺ نے عمرو بن حزم کے ساتھ کیا۔ آپ ﷺ نے ان کی توجہ بعض اہم امور کی طرف بھی مبذول کرائی، جیسا کہ آپ ﷺ نے ابان بن سعید کے ساتھ کیا جب آپ ﷺ نے انہیں بحرین کا والی مقرر کیا اور ان سے فرمایا:

It has been confirmed that the Messenger of Allah (pbuh) would examine the Wulah when appointing them, as He did with Mu’az and Abu Moussa. He used to explain to them how they should conduct their duties, as He did with ‘Amr bin Hazm. He also drew their attention to some important matters as He did with Aban bin Sa’id when He appointed Him Waali over Bahrain and said to him:

"عبد القیس کا خیال رکھو اور ان کے سرداروں کی عزت کرو۔" اسی طرح یہ بھی ثابت ہے کہ آپ ﷺ ولاۃ (صوبائی حکمرانوں) کا محاسبہ فرماتے، ان کے حالات کا جائزہ لیتے اور ان کے بارے میں آپ ﷺ تک پہنچنے والی خبروں کو سنتے تھے۔ آپ ﷺ ولاۃ سے آمدنی اور اخراجات کا حساب مانگتے تھے۔ البخاری اور مسلم نے ابو حمید الساعدی سے روایت کی ہے جنہوں نے کہا؛ "رسول اللہ ﷺ نے ابن العتبیہ کو بنو سلیم کے صدقہ کا عامل مقرر کیا۔ جب وہ نبی ﷺ کی خدمت میں واپس آیا اور آپ ﷺ نے اس کا محاسبہ فرمایا، تو اس نے کہا؛ 'یہ آپ کے لیے ہے اور یہ (وہ ہے جو) مجھے بطور تحفہ دیا گیا ہے۔' تو رسول اللہ ﷺ نے فرمایا؛ 'تم اپنے والدین کے گھر کیوں نہ ٹھہرے تاکہ اگر تم سچ بولتے تو تمہارا تحفہ خود تمہارے پاس آ جاتا۔' پھر رسول اللہ ﷺ منبر پر تشریف فرما ہوئے، لوگوں سے خطاب فرمایا، اللہ سبحانہ و تعالیٰ کی حمد و ثنا کی اور فرمایا؛ 'اس سرکاری عہدیدار کا کیا حال ہوگا جسے میں کوئی ذمہ داری سونپوں اور وہ آ کر کہے؛ 'یہ آپ کے لیے ہے اور یہ مجھے بطور تحفہ دیا گیا ہے؟' وہ اپنے باپ کے گھر یا اپنی ماں کے گھر کیوں نہ ٹھہرتا تاکہ اگر وہ سچا ہوتا تو اس کا تحفہ اس کے پاس پیش کیا جاتا؟ اللہ کی قسم! تم میں سے کوئی بھی اس (صدقہ) میں سے غیر قانونی طور سے کچھ نہیں لے گا مگر وہ قیامت کے دن اسے اپنے گلے میں لاد کر لائے گا، خواہ وہ ایک اونٹ ہو جو دھاڑ رہا ہو، یا ایک گائے جو رنبھ رہی ہو، یا ایک بھیڑ جو می می کر رہی ہو۔' پھر آپ ﷺ نے اپنے ہاتھ اس طرح اٹھائے کہ میں آپ ﷺ کے بغلوں کی سفیدی دیکھ سکوں۔ پھر آپ ﷺ نے دو بار فرمایا؛ 'اے اللہ! میں نے تیرا پیغام پہنچا دیا ہے۔'" عمرؓ ولاۃ کی کڑی نگرانی کیا کرتے تھے، اور انہوں نے محمد بن مسلمہ کو ان کے معاملات کی جانچ پڑتال اور ان کے حالات کے معائنے کے لیے مقرر کیا تھا۔ عمرؓ حج کے موسم میں ولاۃ کو جمع کرتے تھے تاکہ ان کی کارکردگی کا جائزہ لے سکیں اور رعایا کی ان کے خلاف شکایات سن سکیں، اور وہ ان کے ساتھ ولایات کے معاملات پر بھی گفتگو کرتے اور ان کے اپنے حالات کے بارے میں دریافت کرتے تھے۔ مروی ہے کہ حضرت عمرؓ نے ایک بار اپنے اردگرد موجود لوگوں سے فرمایا: "کیا تم یہ کہو گے کہ میرا فرض اس وقت پورا ہو جائے گا اگر میں تم میں سے بہترین شخص کو تمہارا حاکم مقرر کر دوں اور اسے عدل و انصاف کا حکم دے دوں؟" انہوں نے کہا: "جی ہاں۔" آپؓ نے فرمایا: "نہیں، جب تک میں اس کی کارکردگی کی جانچ نہ کر لوں، اور یہ نہ دیکھ لوں کہ آیا اس نے وہ کیا ہے جس کا میں نے اسے حکم دیا تھا۔" حضرت عمرؓ اپنے ماتحتوں اور عاملین کے محاسبے میں سخت مزاج ہونے کے لیے مشہور تھے۔ آپؓ محض ایک شک کی بنیاد پر، بغیر کسی حتمی دلیل کے، ان میں سے بعض کو ہٹا دیا کرتے تھے۔ آپؓ تو ایک والی کو محض اس معمولی شک کی بنیاد پر بھی ہٹا دیا کرتے تھے جو شک کے درجے تک بھی نہ پہنچتا ہو۔ ایک دن آپؓ سے اس بارے میں پوچھا گیا تو آپؓ نے فرمایا: "لوگوں کے معاملات کی اصلاح کے لیے ایک امیر کو دوسرے سے بدلنا آسان ہے۔" تاہم، ان کے ساتھ اپنی سختی کے باوجود، آپؓ انہیں کام کرنے کی مکمل آزادی دیتے تھے اور حکمرانی میں ان کی ساکھ کا تحفظ کرتے تھے۔ آپؓ ان کی بات سنتے اور ان کے دلائل پر غور کرتے تھے۔ اگر آپؓ کو کوئی دلیل پسند آتی تو آپؓ اس پر اپنی منظوری اور یقین کا اظہار کرتے اور بعد میں اس عامل پر تعریفوں کی بارش کر دیتے۔ ایک دن آپؓ تک اپنے عامل عمیر بن سعد کی خبر پہنچی جنہوں نے حمص کے منبر پر یہ کہا تھا: "اسلام اس وقت تک ہی باوقار رہے گا جب تک اقتدار مضبوط ہے۔ اور اقتدار کی مضبوطی تلوار کے وار یا کوڑے کی ضرب سے نہیں، بلکہ حق کے فیصلے اور انصاف کے قیام سے آتی ہے۔" یہ سن کر حضرت عمرؓ نے فرمایا: "کاش میرے پاس عمیر بن سعد جیسا کوئی شخص ہوتا جو مسلمانوں کے معاملات میں میری مدد کرتا۔"

“Look after Abd Qays and honour their leaders.” Likewise it has also been confirmed that He (pbuh) used to hold the Wulah accountable, inspect their situation and listen to news brought to Him about them. He (pbuh) used to ask the Wulah to account for the revenues and expenses spent. Al-Bukhari and Muslim narrated on the authority of Abu Humaid Al-Sa’idi who said; “The Messenger of Allah (pbuh) appointed Ibnul-Utbiyya as ‘Amil in charge of Sadaqat of Banu Saleem. When He returned back to the Prophet (pbuh) and He accounted him, He said; ‘This is for you and (this is a gift) that was presented to me.’ So the Messenger of Allah (pbuh) said ‘Why did you not remain in your father’s and mother’s home so that your gift comes to you if you spoke the truth.’ Then the Messenger of Allah (pbuh) stood on the pulpit, addressed the people praised, Allah (swt) and said; ‘What about a State official whom I give an assignment and who comes and says; ‘This is for you and this has been presented to me as a gift?’ Why didn’t He remain in the house of his father or the house of his mother so that his gift be presented to Him if He is truthful? By Allah, any one of you will not take anything from it (Sadaqah) unlawfully but will bring it on the Day of Judgment, carrying on his neck a camel that will be growling, or a cow that will be bellowing or a sheep that will be bleating.’ Then He raised his hands so that I could see the whiteness of his armpits. Then He said twice; ‘O Allah, I have conveyed your command.’” ‘Umar used to closely monitor the Wulah, and He appointed Muhammad Ibnu Maslama to examine their state of affairs and inspect them. ‘Umar used to gather the Wulah during the Hajj season to review their performance and to listen to the complaints of the subjects about them, and He also used to discuss with them the affairs of the Wilayaat and ask about their own conditions. It has been reported that ‘Umar once said to people around him; “‘Would you say that my duty would be fulfilled if I appointed over you the best from amongst you, and ordered Him to be just?’ They said; ‘Yes.’ He said; ‘No. Not until I had checked his performance, and seen whether or not He did what I had ordered Him to do.’ ‘Umar was known to be strict when accounting the Wulah and the ‘Aamileen. He would even remove some of them on just a suspicion without conclusive evidence. He even used to remove a Waali on the slightest doubt that did not even reach the level of suspicion. He was asked about this one day and He said; ‘It is easy to swap an Ameer for another so as to amend the people’s affairs.’” However, despite his strictness with them He used to give them a free hand and safeguarded their reputation in ruling. He used to listen to them and consider their argument. If He liked an argument He would show his approval and conviction of it and would shower the ‘Amil with praise afterwards. Oneday news reached Him about his ‘Amil Umayr Ibnu Sa’d who had said while over the pulpit of Homs; “Islam will remain formidable as long as the authority is strong. And the strength of the authority does not come about with the killing by the sword or the lashing by the whip, but with the judging by the truth and the upholding of justice.” Upon hearing this ‘Umar said; “I wish I had a man like Umayr Ibnu Sa’d to help me with the Muslims’ affairs.”
