ریاست کے ڈائریکٹرز اور ملازمین کرائے پر لیے گئے عملہ ہیں جن کا معاہدہ بھرتی کے قواعد کے مطابق کیا جاتا ہے۔ ان کا تقرر، برطرفی، تبادلہ اور تادیبی کارروائی ان کے انتظامیہ، ڈائریکٹوریٹ یا محکموں کے سربراہان کے ذریعے اور انتظامی ضوابط کے مطابق کی جائے گی۔

The State’s directors and employees are hired staffs who are contracted in accordance with the rules of hiring. Their appointment, removal, transfer and censure would be carried out by those who head their admistrations, directorates or departments and in accordace to the administrative regulations.

یہ اجرت پر رکھے گئے ملازمین سے متعلق قواعد سے اخذ کیا گیا ہے۔ آجر اور ملازم دونوں کو ملازمت کے معاہدے کی پابندی کرنی چاہیے، کیونکہ معاہدہ دونوں فریقین پر اس کے مطابق لازم ہوتا ہے جس کا تعین کیا گیا ہو۔ مثال کے طور پر، معاہدے کی مدت ختم ہونے سے پہلے ملازم کو کام سے ہٹانا غیر قانونی ہوگا۔

This is deduced from the rules concerning hired personnel. The employer and the employee should abide by the contract of hiring, because the contract is binding on both sides according to what has been contracted. For example, it would be, for instance, unlawful to remove an employee before the term of contract had expired.

عام انتظامی قواعد کی پابندی کرنا معاہدے میں طے شدہ شرائط کا حصہ ہے اور ان کا احترام کرنا ضروری ہے۔ رسول اللہ ﷺ نے فرمایا: "مسلمان اپنے طے کردہ معاہدوں کے پابند ہیں۔" [ابوداؤد نے ابوہریرہ رضی اللہ عنہ سے روایت کیا ہے] جہاں تک عملے کی ایک جگہ سے دوسری جگہ منتقلی کا تعلق ہے، یہ بھی ملازمت کے معاہدے کے تابع ہونی چاہیے۔

Abiding by the general administrative rules, forms part of the conditions laid out in the contract and these must be honoured. The Messenger of Allah (pbuh) said; “The Muslims are bound by their conditions.” [Narrated by Abu Dawoud from Abu Hurairah] As for the transfer of personnel from one place to another, this should also be subject to the contract of employment.

عملے کی بھرتی، تبادلہ، تنبیہ اور برطرفی کا ذمہ دار متعلقہ شعبے، ڈائریکٹوریٹ یا انتظامیہ کا ڈائریکٹر ہوگا۔ اس کی وجہ یہ ہے کہ وہ اپنے کام کے شعبے کا انچارج ہوتا ہے، اور اسے سونپی گئی ذمہ داری کے مطابق وہی اختیار رکھتا ہے۔

The one responsible to hire, transfer, censure and dismiss staff would be the director of the respective department, directorate or administration. This is because He is in charge of the department of their work, and He is the one who has the power according to the responsibility entrusted to him.
