قال الإمام الترمذي: قال رسول الله ﷺ: "حَدُّ السَّاحِرِ ضَرْبَةٌ بِالسَّيْفِ." (حديث ضعيف رواه الترمذي)

A ---Narrated Imam At-Tirmidhi: Allah's Messenger (Peace be upon him) says: "The Prescribed Penalty for the sorcerer is a hit with the sword.” (A Weak Hadith narrated by At- Tirmidhi)

قال الترمذي: وقد أُخذ بهذا الحد أهلُ العلم من أصحاب النبي ﷺ وغيرهم، وهو قول مالك بن أنس.

At-Tirmidhi added: This penalty has been brought into effect by the wellversed from among the companions of Prophet Muhammad (Peace be upon him) and others. This is also the saying of Imam Malik Ibn Anas.

قال الإمام الشافعی: يُقتل الساحر إذا بلغ فعله حدّ الكفر، فإن لم يبلغ ذلك لم يُقتل.

Imam Ash-Shafi' I said: The sorcerer is to be killed if his acts reach the degree of disbelief, but if they do not, he is not to be killed.

وإضافةً إلى ذلك، فقد أُثِر القول بقتل الساحر عن: عمر بن الخطاب، وابنه عبد الله، وابنته حفصة، وعثمان بن عفان، وجندب بن عبد الله، وجندب بن كعب، وقيس بن سعد، وعمر بن عبد العزيز، والإمام أحمد، والإمام أبو حنيفة، وغيرهم كثير.
