8.1 Evidences for Ijtihad from the Sunnah
صحابہ (رضی اللہ عنہم) رسول اللہ ﷺ کے زمانے میں اجتہاد کیا کرتے تھے اور احکام کے استنباط میں آپس میں اختلاف بھی کرتے تھے اور رسول اللہ ﷺ اس بات کو قبول فرماتے تھے۔ اس کی مثال درج ذیل واقعات سے ملتی ہے:
The Sahabah (ra) used to make Ijtihad in the time of the Messenger of Allah (saw) and differ in their deduction of Ahkams and the Messenger (saw) accepted this. This can be seen in the following incidents:
۱) بخاری نے عائشہ رضی اللہ عنہا سے روایت کیا ہے کہ جب نبی ﷺ غزوہ خندق سے واپس آئے تو آپ ﷺ نے اپنے ہتھیار رکھ دیے اور غسل کیا۔ جبرئیل علیہ السلام آئے اور کہا، "آپ نے اپنے ہتھیار رکھ دیے؟ اللہ کی قسم، ہم فرشتوں نے ابھی تک انہیں نہیں رکھا۔ پس ان کی طرف کوچ کریں۔" رسول اللہ ﷺ نے پوچھا، "کہاں کی طرف؟" تو جبرئیل علیہ السلام نے بنو قریظہ کی طرف اشارہ کیا۔ نبی ﷺ نے مؤذن کو اذان دینے کا حکم دیا اور انہوں نے لوگوں میں یہ اعلان کیا:
1) Bukhari narrated from Aisha that when the Prophet (saw) returned from the battle of Khandaq (ditch) and laid down his arms and took a bath. Jibreel came and said, “You have laid down your arms? By Allah, we angels have not laid them down yet. So set out for them.” The Messenger (saw) asked, “where to go?” so Jibreel pointed towards Banu Qurayzah. The Prophet (saw) instructed the Mu`azzin to give Azan and so he announced to the people:
"جو شخص اللہ اور قیامت کے دن پر ایمان رکھتا ہو اسے چاہیے کہ وہ عصر کی نماز بنی قریظہ پہنچے بغیر نہ پڑھے۔" چنانچہ وہ بنی قریظہ کے قلعوں کی طرف روانہ ہوئے، تاہم اس بات کے بارے میں کہ رسول اللہ ﷺ نے ان سے کیا فرمایا تھا، ان کے مختلف مفہوم تھے۔ بعض نے اس کے ظاہری معنی لیے اور انہوں نے مغرب کے بعد بنی قریظہ پہنچنے تک عصر کی نماز نہیں پڑھی۔ اور بعض نے اس کا یہ مطلب لیا کہ انہیں وہاں جلدی پہنچنا چاہیے، چنانچہ انہوں نے مدینہ میں یا راستے میں ہی عصر کی نماز پڑھ لی۔ جب رسول اللہ ﷺ نے اس بارے میں سنا تو آپ ﷺ نے ان سب کے عمل کو درست قرار دیا۔32
“Whosoever believes in Allah and the Day of judgement he should not pray Asr except in Bani Qurayzah.” So thy headed towards the fortresses of Bani Qurayzah, however they had different understandings of what the Messenger (saw) had said to them. Some took the literal meaning and they did not pray until they reached Bani Qurayzah after Maghrib. And others took it to mean that they should go there quickly, so they prayed Asr in Madinah or on the way. When the Messenger (saw) heard about this he accepted the action of all them.32
۲) نبی کریم ﷺ کا فرمان جب آپ ﷺ نے معاذ کو یمن میں قاضی بنا کر بھیجا:
2) The saying of the Prophet (saw) when he sent Mu‟adh as Qadi to Yemen:
"تم کس بنیاد پر فیصلہ کرو گے؟" اس نے کہا: اللہ کی کتاب کے ذریعے، نبی ﷺ نے فرمایا: اگر تمہیں وہ اس میں نہ ملے؟ اس نے کہا: اللہ کے رسول ﷺ کی سنت کے ذریعے، آپ ﷺ نے فرمایا: اور اگر تمہیں وہ نہ ملے؟ اس نے کہا: "میں اپنا اجتہاد کروں گا"۔ آپ ﷺ نے فرمایا:
“By what will you pass judgement?‟ He said: By the Book of Allah. The Prophet (saw) said: If you do not find it there? He said: By the Sunnah of the Messenger of Allah (saw). He said: And if you do not find it? He said: 'I will exercise my own Ijtihad‟. He (saw) said:
"تمام تعریفیں اللہ کے لیے ہیں جس نے اللہ کے رسول ﷺ کے رسول کے (عمل و کیفیت کو) اس کے مطابق کر دیا جسے اللہ اور اس کا رسول ﷺ پسند کرتے ہیں۔"33
“Praise be to Allah who has made the messenger of the Messenger of Allah to accord with what Allah and His Messenger loves.”33
۳) رسول اللہ ﷺ کی حدیث:
3) The Hadith of the Messenger (saw):
"اگر کوئی قاضی فیصلہ کرے اور اجتہاد کرے اور وہ حق پر ہو تو اسے دو اجر ملیں گے، اور اگر اس سے غلطی ہو جائے تو اسے ایک اجر ملے گا۔"34
“If a judge passes judgment and makes Ijtihad and he is right then he will have two rewards. And if he makes a mistake he will have one.”34
۴) اللہ کے رسول ﷺ نے سعد بن معاذؓ کو بنی قریظہ پر فیصلہ کرنے کے لیے مقرر کیا، چنانچہ انہوں نے فیصلہ دیا کہ انہیں قتل کر دیا جائے اور ان کی اولاد کو قیدی بنا لیا جائے۔ اللہ کے رسول ﷺ نے فرمایا:
4) The Messenger of Allah (saw) made Sa‟d b. Mu‟adh to judge over Bani Qurayzah so he gave the judgment that they should be killed and their offspring to be taken prisoners. The Messenger (saw) said:
"آپ نے ایسا فیصلہ دیا ہے جو ساتوں آسمانوں کے اوپر سے ہے۔"35
“You have given a judgment that is from above the seven heavens.”35
ان مثالوں سے ہم دیکھ سکتے ہیں کہ صحابہ کرام رسول اللہ ﷺ کے زمانے میں اجتہاد کیا کرتے تھے اور آپ ﷺ ان کے اجتہادات کو قبول فرماتے تھے اور انہیں فرماتے تھے کہ جس نے درست اجتہاد کیا اسے دو اجر ملیں گے جبکہ جس نے غلطی کی اسے ایک اجر ملے گا۔
From these examples we can see that the Sahabah used to make Ijtihad in the time of the Messenger (saw) and that he used to accept their Ijtihads and tell them that the one who got it right will get two rewards while the one who got it wrong will get one.
