اصول فقہ پر مختلف کتب انگریزی میں دستیاب ہیں، تاہم ان کا جائزہ لینے کے بعد یہ بات واضح ہو جاتی ہے کہ ان میں سے اکثر عام قاری کے بجائے علمی مقاصد کے لیے لکھی گئی ہیں۔ اس سلسلے میں ابو طارق ہلال کی لکھی ہوئی بہترین کتاب بعنوان "Studies in Usul al-Fiqh" نمایاں ہے۔ یہ ایک واضح اور سادہ انداز میں لکھی گئی ہے جو ایک عام قاری کے لیے قابلِ فہم ہے۔

Various books on Usul al-Fiqh are available in English, however after reviewing them it becomes clear that most are written for academic purposes rather than for the normal reader. In this regard the excellent book written by Abu Tariq Hilal entitled „Studies in Usul al-Fiqh‟ stands out. It was written in a clear simple style understandable to the average reader.

میں نے کتاب کی ترتیب میں تھوڑی تبدیلی کی ہے تاکہ قوانین کے قطعی ذرائع پر ان ذرائع سے پہلے بحث کی جائے جن میں علماء کے درمیان اختلاف پایا جاتا ہے۔ اصل کتاب میں قرآن، قیاس، اجتہاد اور تقلید کے ابواب مختصر تھے۔ میں نے ان میں اضافہ کیا ہے اور بعض مقامات پر ان حصوں کو دوبارہ لکھا ہے جہاں تفصیل کی ضرورت تھی۔ شک اور بے یقینی کے اس دور میں، میں نے کچھ تعریفات اور احادیث کے لیے کچھ نصّی دلائل اور انتہائی ضروری حوالہ جات شامل کرنا ضروری سمجھا۔ اس ترمیم شدہ نسخے کو اصل سے ممتاز کرنے کے لیے ایک نیا عنوان دیا گیا ہے جو اصل کی سادگی کو برقرار رکھتا ہے۔

I have slightly restructured the book so that the definitive sources of law are discussed before those upon which there is disagreement amongst the scholars. The chapters on the Quran, Qiyas, Ijtihad and Taqleed were brief in the original. I have added to these and in some cases rewritten sections where elaboration was required. In this age of doubt and scepticism I felt it necessary to add some textual evidences and much needed references for some definitions and Ahadith. To distinguish this amended version from the original a new title has been given that keeps to the simplicity of the original.

یہ واضح ہے کہ اصل تحریر لکھتے ہوئے ابو طارق نے شیخ تقی الدین النبحی کے شاہکار "شخصیتِ اسلامیہ" کا حوالہ دیا ہے۔ میں نے بھی یہی کیا ہے، نیز شیخ عطا بن خلیل ابو الرشتہ (اللہ ان کی حفاظت فرمائے) کی بہترین کتاب "تیسر الوصول الی الاصول" کا بھی حوالہ دیا ہے۔

It is clear that in writing the original, Abu Tariq referred to Sheikh Taqiuddin an-Nabhani‟s (ra) masterpiece „Shaksiyyah Islamiyyah‟ (The Islamic Personality). I have done the same, as well as referring to the excellent book „Teyseer al wusool Ila al-Usul‟ (To make understanding Usul easy) by Sheikh Ata ibn Khalil Abu al-Rishta (May Allah protect him).

میں شیخ ابو عمر الخزرجی کا ان کی حمایت اور کتاب کی جانچ پڑتال کے لیے، مولانا عمر فاروق ندوی کا اس کا موازنہ کرنے کے لیے، قاری فضل کریم کا عربی میں مدد کے لیے، اور اپنی اہلیہ شفا کا ان کی قیمتی رائے اور حمایت کے لیے شکریہ ادا کرنا چاہتا ہوں۔
