3.6 Asbaab An-nuzool (circumstances Of Revelation)

Some jurists have coined the term „Asbab an-nuzool‟ for incidents that the revelation came to clarify.
De vraag rijst zich: blijven deze Ahkam specifiek beperkt tot deze incidenten en gaan ze daar niet voorbij, of passen we deze Ahkam toe op elk vergelijkbaar incident?
The question arises, do these Ahkam remain specific to these incidents and not go beyond them or do we apply these Ahkam on every similar incident?
Het antwoord is dat deze Ahkam worden toegepast op elk vergelijkbaar incident, en dit wordt op twee manieren vastgesteld:
The answer is, these Ahkam are applied on every similar incident and this is established in two ways:
1. Door alle verzen (Ayah's) te onderzoeken die werden geopenbaard om de regels van deze incidenten toe te lichten, zien we dat zij kwamen met uitdrukkingen die algemeen en niet specifiek waren, en daarom moeten zij in hun algemeenheid worden genomen.
1. By examining all the Ayat which were revealed clarifying the rules of these incidents we find that they came with expressions that were general and not specific and hence they must be taken in their generality.
2. De Boodschapper ﷺ nam deze Ahkam in hun algemeenheid en paste ze toe op elk vergelijkbaar incident.
2. The Messenger (saw) took these Ahkam in their generality and applied them on every similar incident.
Dus het vers (Ayah) over diefstal werd geopenbaard naar aanleiding van de diefstal van Majn of Rida van Safwaan, het vers (Ayah) over Zihar met betrekking tot Salamah bint Sakhar of Khawlah bint Tha‟labah, de vrouw van Aws b. Saamit, het vers (Ayah) over de vervloeking (Li‟aan) met betrekking tot Hilal b. Umayyah. Hoewel ze allemaal werden geopenbaard naar aanleiding van specifieke incidenten, namen de Boodschapper ﷺ en de metgezellen (Sahabah) (moge Allah tevreden met hen zijn) ze als algemeen aan vanwege hun algemene vorm, en pasten ze deze toe op elk vergelijkbaar incident. Dit wordt bewezen door de profetische traditie (Sunnah) en de consensus (Ijma’) van de metgezellen (Sahabah).
So the Ayah of stealing was revealed regarding the theft of Majn or Rida of Safwaan, the Ayah of Zihar with regards to Salamah bint Sakhar or Khawlah bint Tha‟labah the wife of Aws b. Saamit, the Ayah of imprecation (Li‟aan) regarding Hilal b. Umayyah. Even though they were all revealed regarding specific incidences the Messenger (saw) and the Sahabah (may Allah be pleased with them) took them as general due to their general form and they applied them on every similar incident. This is proven by the Sunnah and Ijma of the Sahabah.
Uit deze bewijzen werd het volgende Shari'ah-principe afgeleid: „De overweging is gebaseerd op de algemeenheid van de bewoording en niet op de specifiekheid van de oorzaak“ (Al-„ibra bi „umoom al-lafz laa bi khususiyyat as-sabab).
It was from these evidences that the follwing Shari‟ah principle was deduced: „The consideration is for the generality of the expression and not for the specificity of the cause‟ (Al-„ibra bi „umoom al-lafz laa bi khususiyyat as-sabab).
