代行を任された者(補佐)が満たすべき条件は、カリフに求められる条件と同じです。すなわち、男性であること、自由人であること、ムスリムであること、成人であること、正気であること、公正であること、そして任された職務において有能であることです。

The delegated assistant should meet the conditions required in the Khaleefah i.e. to be male, free, Muslim, mature, sane, just and cometent in what is assigned to Him in terms of duties delegated to him.

これらの条件の根拠は、カリフの地位に関する条件の根拠と同じである。したがって、補佐役は男性でなければならない。預言者ﷺが次のように仰ったからである。

Evidences of these conditions are the same as those of the conditions of the Khaleefah post. Therefore, the assistant should be male, for the Messenger of Allah (pbuh) said:

「女性に自分の事務を任せる者は、決して成功しない。」[アブー・バクラ経由でアル＝ブハーリーが伝承] また、統治者は自由人でなければならない。奴隷は自分自身の事柄に対する権限を持たないため、他人の事柄を取り仕切ることはできないからである。さらに、成人であることも必要である。預言者ﷺは次のように仰せになった。

“People who appoint a woman to run their affairs shall never succeed.” [Narrated by al-Bukhari on the authority of Abi Bakra] He must also be free, for the slave does not have authority over his own affairs, thus He cannot run other people’s affairs. He should also be mature, for the Messenger of Allah (pbuh) said:

「三種類の人は責任を免除される。眠っている者は目覚めるまで、子供は思春期に達するまで、狂気の者は治癒するまで」。[アブー・ダーウード伝承] 同じハディースの中で、預言者ムハンマドﷺは次のように述べられたので、彼も正気でなければならない。

“Three types of people are exempted from accountability, the one who sleeps until He wakes up, a child until He reaches the age of puberty and the insane until He is cured.” [Narrated by Abu Dawood] He also should be sane, for in the same Hadith, the Messenger of Allah (pbuh) said:

「……そして狂人は、正気に戻るまで（免除される）。」別の伝承では、「理性が覆われた者は、理性を取り戻すまで」と述べられている。また、ムアーウィン（証人の審査役）も、アッラーが証言の条件とされたがゆえに、公正でなければならない。アッラーはこう仰っている。

“...and the insane until He is cured.” In another narration the Hadith states “...about the one whose mind is overpowered until He regains his mind.” Mu’awin should also be just for Allah (swt) has made it a condition in testimony. He (swt) says:

「あなたがたの中から公正な二人の者を証人として立てなさい」 [TMQ Al-Baqarah: 282]

“Let two just people from amongst you bear witness.” [TMQ Al-Baqarah: 282]

それゆえ、カリフの補佐官には公正さがいっそう求められる。ムアーウィン（補佐官）もまた統治の職務に適した有能な人物でなければならず、カリフがカリフ制の任務と統治・権威の責任を担う際に助けとなれるようにしなければならない。

Therefore, there is more reason to require justice in the assistant of the Khaleefah. The Mu’awin should also be from the competent people in the duties of ruling, in order to be able to assist the Khaleefah in shouldering the tasks of the Khilafah and the responsibility of ruling and authority.
