7.3 Les conditions requises pour la nomination de l'Assistant Délégué - Le système de gouvernance en Islam | Quran Course

La preuve de cela est la réalité de la fonction de l'assistant, qui est la délégation du calife. La délégation, dans ce contexte, est un contrat (‘Aqd), et les contrats ne sont valides que par des paroles explicites. Par conséquent, il est conditionné dans la nomination de l'assistant que cette nomination soit effectuée selon des termes qui font de lui un délégué du calife. De plus, la réalité de l'assistant est qu'il possède tous les pouvoirs obligatoires dont le calife jouit dans le gouvernement. Par conséquent, la nomination doit être générale en tout, c'est-à-dire qu'elle doit inclure un terme indiquant la considération générale des affaires. En d'autres termes, la nomination doit inclure un terme indiquant que l'assistant jouit de tous les pouvoirs obligatoires du gouvernement. Cela se fait en lui disant, par exemple : « Je t'ai assigné ce qui m'appartient afin d'agir en mon nom », ou en disant « Je t'ai pris comme Wazir dépendant de ton action en mon nom », ou quelque chose de semblable. Cependant, lui donner la considération générale sans mentionner explicitement « en mon nom » signifie devenir un héritier présomptif (Wilayat ul-’Ahd) et non un contrat de Wizara, et le poste d'héritier présomptif (Wilayat ul-’Ahd) est invalide, de sorte qu'un tel contrat serait également invalide. Si l'assignation était limitée à la délégation, sans mentionner explicitement sa considération générale, elle deviendrait une délégation ambiguë en termes de généralité ou de spécification, d'exécution ou de délégation, et par conséquent la Wizara ne serait pas établie. Si le calife lui disait également : « représente-moi dans les affaires judiciaires, ou dans les affaires de police, d'éducation ou de même nature », la Wizara ne serait pas établie et il ne serait pas un assistant délégué. Cela est dû au fait qu'il est nécessaire, lors de la nomination de l'assistant délégué, d'utiliser des mots ou des termes qui indiquent la réalité de l'assistant, qui est la délégation du calife et la possession de ses pouvoirs obligatoires. En d'autres termes, afin que le contrat de la Wizara soit conclu pour l'assistant délégué, il doit inclure une clause indiquant deux conditions : la délégation générale et la députation. Si la clause ne couvrait pas clairement ces deux conditions, la Wizara ne serait pas conclue pour l'assistant délégué. Puisque la nomination des assistants est l'une des questions Mubah, alors le calife est autorisé à nommer un ou plusieurs assistants. Si le calife nommait plus d'un Mu’awin, alors chacun d'eux recevrait la même considération générale que celle du calife. Il ne serait pas permis au calife de nommer deux Mu’awins qui partageraient collectivement la même supervision générale, puisque la province (Wilayah) de gouvernance est singulière. Par conséquent, s'il agissait ainsi, la nomination des deux ne serait pas autorisée et serait nulle, car il s'agit de la nomination d'un émir et cela ne pourrait être destiné qu'à un seul individu. Cela est dû au fait que le Messager d'Allah ﷺ a dit,

The evidence for this is the reality of the assistant’s function, which is deputyship of the Khaleefah. Deputisation, in this context, is a contract (‘Aqd), and contracts will not be valid except through explicit words. Therefore, it is conditional in appointing the assistant that this appointment is carried out in terms that make of Him a deputy to the Khaleefah. Furthermore, the reality of the assistant is that He possesses all the mandatory powers, which the Khaleefah enjoys in ruling. Hence, the appointment must be general in everything, i.e. it must include a term that indicates the general consideration of matters. In other words, appointment should include a term that indicates that the assistant enjoys all the mandatory powers of ruling. This is done by saying to Him for example; “ I assigned to you what is to me so as to act on my behalf ”, or to say “I took you as a Wazir depending on your action on behalf of me”, or the like. However, giving Him the general consideration without stating ‘on behalf of me’ means to become an heir apparent (Wilayat ul- ’Ahd) not a contract of Wizara, and the heir apparent (Wilayat ul-’Ahd) post is invalid, so such a contract would be invalid as well. If the assignment was limited to deputisation, without explicitly mentioning its general consideration, then it would become an ambiguous deputisation in terms of generality or specification, execution or delegation and accordingly the Wizara would not be convened. If the Khaleefah also said to him, “represent me in judicial matters, or in the matters of policing, education or the like”, the Wizara would not be convened and He would not be a delegated assistant. This is because it is necessary in appointing the delegated assistant to use words or terms that indicate the reality of the assistant, which is the deputyship of the Khaleefah and the possession of his mandatory powers. In other words, in order that the contract of the Wizara be convened for the delegated assistant, it should include a term that indicates two conditions; the general delegation and the deputisation. If the term did not clearly cover these two conditions, the Wizara would not be convened to the delegated assistant. Since the assignment of the assistants is one of the Mubah matters, then the Khaleefah is allowed to appoint one or more assistants. If the Khaleefah appointed more than one Mu’awin, then each of them would be given the same general consideration that the Khaleefah has. It would not be allowed for the Khaleefah to appoint two Mu’awins who would share collectively the same general supervision, since the Wilayah of ruling is singular. Therefore, if He did so, then the assignment of both would not be allowed and void, for it is an appointment of an Ameer and this could only be to one individual. This is because the Messenger of Allah (pbuh) said,
