Deve-se notar que as punições aplicadas pelo Estado Islâmico são o último recurso no processo de conter e prevenir o crime. O Islã vem como um dīn (modo de vida), no qual todos os sistemas funcionam em harmonia, formando um todo integrado e perfeitamente complementar.

It must be noted that the punishments administered by the Islamic State are the last resort in the process of curbing and preventing crime. Islam comes as a deen (way of life) where all the systems work in harmony, making an integrated and perfectly complementary whole.

Assim, o Sistema Econômico garantirá que todos os cidadãos do Estado tenham suas necessidades adequadamente atendidas, de modo que ninguém precise recorrer ao crime para se sustentar. Além disso, o Sistema Educacional ensinará às pessoas a mentalidade de rejeitar qualquer tipo de crime, todos os quais são proibidos no Islã, em favor da obediência a Allah (SWT). E o Sistema Social incutirá nas pessoas a mentalidade de respeito e dignidade em relação ao sexo oposto, e a segregação entre homens e mulheres em sua vida diária minimizará a possibilidade de crimes nessa área.

Thus, the Economic System will ensure that all the citizens of the State will have their needs adequately fulfilled such that no-one need resort to crime to sustain themselves. As well, the Education System will teach the people the mentality of rejecting any kind of crime, all of which are forbidden in Islam, in favour of obedience to Allah (swt). And the Social System will inculcate within the people the mentality of respect and dignity towards the opposite sex, and the segregation between men and women in their daily life will minimise the possibility of crimes in this area.

O muçulmano tem convicção no credo racional do Islã, que se apoia no estudo da realidade e no uso da mente. Isso lhe dá o fundamento firme para sua crença no Islã e o motiva a submeter-se ao único e verdadeiro Deus, Allah (SWT).

The Muslim has conviction in the rational creed of Islam, which is built upon the study of reality and use of the mind. This gives them the definite foundation for their belief in Islam and motivates them to be subservient to the One and Only True God, Allah (swt).

O crime é uma desobediência a Allah (SWT). O anseio do muçulmano pelo Paraíso e o seu temor ao castigo do Fogo do Inferno o impedirão de cometer crimes.

Crime is a disobedience to Allah (swt). The Muslim’s longing for the Paradise and their fear of the punishment of Hellfire will prevent them from committing crime.

É um dos direitos e deveres mútuos dos muçulmanos que eles sempre zelem pelos assuntos uns dos outros e cuidem deles. Assim, haverá uma motivação e um incentivo constantes de todos os lados para que as pessoas observem a conduta islâmica.

It is one of the mutual rights and duties of the Muslims that they always look out for and take care the affairs of each other. Thus there will be a constant motivation and encouragement from all sides for people to observe the Islamic conduct.

O crime será repudiado e rejeitado pela sociedade em geral. Criminosos e trapaceiros não serão aceitos, nem a riqueza ou quaisquer benefícios aparentes obtidos ilicitamente serão respeitados. Esta pressão dos valores dominantes da sociedade impedirá que aqueles que são tentados a cometer crimes o façam.

Crime will be shunned and rejected by the society at large. Criminals and cheats will not be accepted, nor will wealth or any perceived benefits gained illicitly be respected. This pressure from the dominant values in the society will prevent those who are tempted to commit crime from doing so.

A última instância é o medo das consequências das ações criminosas em termos de punição.

The last resort is the fear of the consequences of the criminal actions in terms of the punishment.

Por essas razões, foram muito poucos os casos de aplicação dos hudud e de outras retribuições pelo judiciário ao longo da história do Califado.

It is for these reasons that so few incidences of implementation of hadud and other retributions by the judiciary were necessary in the history of the Khilafah.
