La designación de un miembro del poder judicial es uno de los contratos islámicos, y todo contrato en el Islam tiene dos contratantes. Uno es el Estado Islámico, representado por el Khalifa, y el otro es el propio juez. El contrato se manifiesta mediante una oferta y una aceptación.
