বিচার বিভাগ হলো সেই বিধানের ঘোষণা যা বাধ্যতামূলক হয়ে ওঠে। এটি মানুষের মধ্যকার বিবাদ মীমাংসা করে এবং সমাজের অধিকারের ক্ষতি করে এমন কার্যকলাপ প্রতিরোধ করে, অথবা রাষ্ট্রীয় ব্যবস্থার সদস্যদের – শাসক ও সরকারি কর্মকর্তা উভয়ই, রাষ্ট্রপ্রধান থেকে শুরু করে নিচের স্তর পর্যন্ত – এবং মানুষের মধ্যে উদ্ভূত বিরোধের অবসান ঘটায়।

The Judiciary is the pronouncement of the rule that becomes binding. It settles the disputes between the people and prevents that which harms the community’s rights, or it eliminates the disputes arising between people and members of the ruling system – both rulers and civil servants – from the Head of State downwards.

বিচারব্যবস্থার উৎস ও তার বৈধতার ভিত্তি হলো কিতাব ও সুন্নাহ। কিতাবের ক্ষেত্রে, আল্লাহ (SWT)-এর বাণী।

The origin of the judiciary and its legitimacy is the Book and the Sunnah. As for the Book, the words of Allah (swt).

“এবং আল্লাহ যা অবতীর্ণ করেছেন, তদনুসারে আপনি তাদের মধ্যে বিচার করুন” (তাফসীর মাআরিফুল কুরআন ৫:৪৫) ﷺ, এবং তাঁর (সুবহানাহু ওয়া তাআলা) বাণী।
