Para pegawai negeri di negara semuanya adalah karyawan, sesuai dengan aturan kepegawaian. Pengangkatan dan pemberhentian, pemindahan serta pendisiplinan mereka dilakukan oleh orang yang bertanggung jawab atas administrasi tertinggi di kantor, departemen, atau instansi mereka.

The civil servants in the state are all employees, in accordance with the rules of employment. Their appointment and removal, transfer and discipline, are done by the one responsible for the highest administration of their offices, departments or administration.

Ini didasarkan pada kaidah-kaidah tentang ketenagakerjaan, karena wajib bagi (pekerja) untuk memenuhi apa yang diwajibkan oleh kontraknya, sebagaimana wajib pula bagi (pemberi kerja) untuk memenuhi apa yang ia sepakati dalam kontrak, sebab akad itu mengikat kedua belah pihak atas apa yang mereka sepakati. Maka jika seorang pekerja dipekerjakan untuk jangka waktu tertentu, tidak sah memberhentikannya dari pekerjaan yang ia tugaskan selama jangka waktu yang telah ditentukan.

This is based on the rules regarding employment, since it is obligatory to adhere to whatever is necessitated by their contract, just as it is obligatory upon him to adhere to what he was contracted for, since the contract is binding upon both parties upon what they agreed, so if the employee is employed for a period, it is not valid to remove him from what he was employed to do for the defined period.

Adapun kepatuhan terhadap sistem-sistem administratif, hal ini dipandang sebagai salah satu syarat kepegawaian yang wajib dipatuhi. Beliau berkata,

As for the adherence to the administrative systems, this is considered from the conditions of employment that must be adhered to. He said,

"Kaum Muslimin terikat dengan syarat-syarat mereka" (diriwayatkan oleh Abu Dawud dari Abu Hurairah). Terkait pemindahan pegawai negeri sipil dari satu tugas ke tugas lain, hal ini termasuk dalam kontrak kerja, sehingga diperlakukan sesuai dengan kontrak pada saat pengangkatan.

“The Muslims will be bound by their conditions” (reported by Abu Dawud from Abu Hurayrah). With respect to transferring the civil servants from one task to another, this falls under the employment contract and so it is treated according to the contract when appointed.

Pihak yang bertanggung jawab untuk mengangkat, memberikan sanksi disiplin, dan memberhentikan mereka adalah orang yang memegang pimpinan tertinggi atas kantor, departemen, dan administrasi mereka, karena dialah yang bertanggung jawab atas kantor tempat mereka bekerja, dan dialah yang memiliki kewenangan yang diperlukan oleh tanggung jawab yang telah dibebankan kepadanya.

The one responsible to appoint, discipline and remove them is the one who is in charge of the highest administration of their offices, departments, and administrations, since he is the one who is responsible for the office they work in, and is the one who has the power that is necessitated by the responsibility he has been assigned to.
