Los funcionarios civiles del Estado son todos empleados, de acuerdo con las normas de empleo. Su nombramiento y destitución, traslado y disciplina, son llevados a cabo por el responsable de la máxima administración de sus oficinas, departamentos o administración.

«Los musulmanes se atendrán a sus condiciones» (narrado por Abu Dawud de Abu Hurayrah). En cuanto al traslado de los funcionarios de una tarea a otra, esto entra dentro del contrato de trabajo y, por tanto, se rige por el contrato en el momento de su nombramiento.

La persona responsable de nombrarlos, disciplinarlos y destituirlos es quien tiene a su cargo la administración superior de sus oficinas, departamentos y administraciones, ya que es él quien responde por la oficina en la que trabajan, y es quien posee la autoridad que requiere la responsabilidad que le ha sido encomendada.
