Um líder temporário é nomeado para assumir a condução dos assuntos dos muçulmanos e para preparar a eleição do novo Khalifah após a vacância do cargo de Khilafah, segundo o seguinte processo:

A temporary leader is appointed to take charge of the affairs of the Muslims, and to prepare for the election of the new Khalifah after the vacation of the position of the Khilafah according to the following process:

a. Quando o Khalifah anterior sente que sua vida está chegando ao fim, ou está comprometido a renunciar, ele tem o direito de nomear o líder temporário.

a. When the previous Khalifah feels that his life is coming to an end, or is committed to resigning, he has the right to appoint the temporary leader.

b. Se o Khalifah morrer ou renunciar antes de nomear o líder temporário, ou se o cargo do Khilafah ficar vago por outro motivo, então o mais velho dos assistentes torna-se o líder temporário, a menos que ele tenha pretendido ser candidato ao Khilafah; nesse caso, o cargo será dado ao assistente mais antigo seguinte, e assim sucessivamente.

b. If the Khalifah dies or resigns before appointing the temporary leader, or the position of the Khilafah becomes vacant due to another reason, then the eldest of the assistants becomes the temporary leader unless he intended to be a candidate for the Khilafah in which case the next senior assistant is to be given the position and so on.

c. Se todos os auxiliares pretenderem ser candidatos, então o mais velho dos ministros executivos se tornará o líder temporário, ou o próximo em antiguidade, caso ele pretenda ser candidato, e assim por diante.

c. If all of the assistants intend to be candidates, then the eldest of the executive ministers will become the temporary leader or the one after him in seniority if he intends to be a candidate, and so on.

d. Se todos os ministros executivos pretenderem ser candidatos ao Khilafah, então o cargo de líder interino é atribuído ao ministro executivo mais jovem.

d. If all of the executive ministers intend to be candidates for the Khilafah, then the position of the temporary leader is given to the youngest executive minister.

e. O líder temporário não tem o direito de adotar regras. f. O líder temporário faz todo o esforço para concluir a nomeação de um novo Khalifah dentro de três dias, e não é permitido que este prazo seja prorrogado, exceto por circunstâncias avassaladoras aprovadas pelo tribunal de Madhalim.

e. The temporary leader does not have the right to adopt rules. f. The temporary leader makes all effort to complete the appointment of a new Khalifah within three days, and it is not permitted for this to be extended except due to overwhelming circumstances approved by the Madhalim court.

Quando o Khalifah sentir que sua morte está próxima, próxima do momento em que o Khilafah ficaria vago, ele pode nomear um líder temporário para ser responsável pelos assuntos dos muçulmanos durante o período em que são tomadas as medidas para nomear o novo Khalifah. Este assumiria sua função após a morte do Khalifah, e seu trabalho principal seria concluir a nomeação do novo Khalifah dentro de três dias.

When the Khalifah feels that his death is close, close to the time that the Khilafah would become vacant, he may appoint a temporary leader to be responsible for the Muslims’ affairs during the period of steps being taken to appoint the new Khalifah. He would undertake his work after the death of the Khalifah and his main work would be to complete the appointment of the new Khalifah within three days.

Não é permitido ao líder temporário adotar leis, pois este é o direito do Khalifah a quem a Ummah deu o juramento de lealdade (bay'ah). Da mesma forma, não é permitido que ele seja indicado para o Khilafah nem que apoie os indicados, visto que 'Umar (ra) nomeou alguém diferente daqueles que haviam sido indicados para o Khilafah.

It is not permitted for the temporary leader to adopt rules, since this is the right of the Khalifah who has been given a pledge by the Ummah. In the same manner, it is not permitted for him to be nominated for the Khilafah or to support the nominees, since Umar (ra) appointed someone other than those who were nominated for the Khilafah.

A responsabilidade deste líder termina com a nomeação do novo Khalifah, visto que a sua tarefa era limitada no tempo a este objetivo.

The responsibility of this leader ends with the appointment of the new Khalifah since his task was time-constrained to this goal.

A evidência para isso é o que Umar (ra) fez quando foi esfaqueado, e isso foi feito sem qualquer oposição dos companheiros, por isso é considerado um Ijma’. Umar (ra) disse aos seis candidatos.

The evidence for this is what Umar (ra) did when he was stabbed and this was done without any opposition from the companions and so is considered to be an Ijma’. Umar (ra) said to the six candidates.

. » وليصلِّ بكم صهيب هذه الأيام الثلاثة التي تتشاورون فيها « .

. » وليصلِّ بكم صهيب هذه الأيام الثلاثة التي تتشاورون فيها « .

"Que Suhayb conduza vocês nas orações durante os três dias da vossa consulta", e então ele disse a Suhaib, como mencionado em Tarikh Al-Tabari: ... صل بالناس ثلاثة أيام، إلى أن قال: فإن اجتمع خمسة، ورضوا رجلاً، وأبى « »... واحد، فاشدخ رأسه بالسيف ... "conduza o povo na oração por três dias ... até que disse: se cinco deles concordarem com um homem enquanto um discordar, então golpeie sua cabeça com a espada..." Isso significa que Suhaib foi nomeado como líder sobre eles — foi designado como líder da oração, e a liderança da oração significava liderança sobre o povo. Além disso, foi-lhe dado o direito de aplicar a punição (golpear sua cabeça), e somente o líder pode estabelecer a pena de morte.

“Let Suhayb lead you in prayers during the three days of your consultation” and then he said to Suhaib, as mentioned in Tarikh Al-Tabari,. .. صل بالناس ثلاثة أيام، إلى أن قال: فإن اجتمع خمسة، ورضوا رجلاً، وأبى « »... واحد، فاشدخ رأسه بالسيف .. “lead the people in prayer for three days ..until he said: if five of them agree upon a man while one disagreed, then strike his head with a sword..”. This means that Suhaib was appointed as a leader over them – he was appointed as a leader for the prayer and leadership of the prayer meant leadership over the people. Also, he was given the right to apply the punishment (strike his head) and the only one who can establish punishment by death is the leader.

Este caso ocorreu diante dos companheiros sem que houvesse qualquer divergência, e por isso constitui um Ijma' de que o Khalifah pode nomear um líder temporário que conduza os passos para a nomeação de um novo Khalifah. Da mesma forma, com base nisto, é permitido que o Khalifah, durante a sua vida, adote um artigo que estabeleça que, caso ele morra sem nomear um líder temporário para supervisionar a nomeação de um novo Khalifah, determinada pessoa será o líder temporário.

This issue took place in front of the companions without any dissenters and so it is an Ijma’ that the Khalifah can appoint a temporary leader who undertakes the steps to appoint the new Khalifah. In the same manner based upon this it is permitted for the Khalifah during his lifetime to adopt an article which would state that if he died without appointing a temporary leader to oversee the appointment of a new Khalifah, someone is to be the temporary leader.

Com base nisso, adota-se que, se o Khalifah não tiver nomeado um líder interino durante sua doença terminal, então o líder interino será o mais velho de seus assistentes, desde que este não seja um candidato; nesse caso, será o próximo em idade entre seus assistentes, e assim por diante, e depois os ministros executivos da mesma forma.

Based upon this, it is adopted that if the Khalifah did not appoint a temporary leader during his terminal illness, then the temporary leader would be the eldest of his assistants as long as they are not a candidate, in which case it would be the next senior in age from his assistants, and so on, and then the executive ministers in the same manner.

Isso se aplica no caso de remoção do Califa, de modo que o líder temporário seria o mais velho dos assistentes, desde que não seja candidato; e, se ele for candidato, então o próximo em antiguidade, e assim por diante, até que todos os assistentes sejam considerados, caso em que a responsabilidade recairia então sobre o mais velho dos ministros executivos, e assim por diante. Se todos eles quiserem ser candidatos, então o mais jovem dos ministros executivos é obrigado a se tornar o líder temporário.

This is applied in the event of the removal of the Khalifah, so the temporary leader would be the eldest assistant as long as he is not a candidate, and if he is a candidate then the next one in seniority and so on until all the assistants are considered, in which case it would then fall to the eldest executive minister and so on. If all of them want to be candidates then the youngest of the executive ministers is compelled to become the temporary leader.

Este líder é diferente daquele que o Califa nomeia em seu lugar quando sai para o Jihad ou para uma viagem, como o Profeta ﷺ costumava fazer quando saía para o Jihad ou para o último Hajj, ou situações semelhantes. Nesta situação, aquele que é delegado em seu lugar possui os poderes que o Califa define para ele, a fim de cuidar dos assuntos que a delegação exige.

This leader is different from the one the Khalifah appoints in his place when he goes out for Jihad or a journey, as the Prophet (phuh) used to do when he went out for Jihad or the final Hajj, or similar. In this situation the one who is delegated in his stead has the powers that the Khalifah defines for him to take care of the affairs necessitated by the delegation.
