Der Staat beaufsichtigt die landwirtschaftlichen Angelegenheiten und deren Erzeugnisse entsprechend den Erfordernissen der Agrarpolitik, deren Ziel es ist, das Potenzial des Landes auf die höchstmögliche Produktionsstufe zu bringen.

The State supervises agricultural affairs and its produce in accordance with the needs of the agricultural policy which is to achieve the potential of the land to its greatest level of production.

Its evidence is the words of the Prophet :

. » الإِمَامُ رَاعٍ وَهُوَ وَمَسْؤُولٌ عَنْ رَعِيَّتِهِ «.

. » الإِمَامُ رَاعٍ وَهُوَ وَمَسْؤُولٌ عَنْ رَعِيَّتِهِ «.

„Der Imam ist ein Hüter, und er ist für seine Untergebenen verantwortlich“ (überliefert von Al-Bukhari von ‘Abd Allah (swt) b. Umar). Die Aufsicht über die allgemeinen landwirtschaftlichen Angelegenheiten gehört zur Verwaltung der Angelegenheiten, weshalb sie zu den Pflichten der Verwaltung des Imams zählt. Der Staat übernimmt die landwirtschaftlichen Angelegenheiten jedoch nicht selbst, denn der Gesandte Allahs ﷺ überließ sie den Muslimen; er sagte in der Überlieferung bezüglich der Befruchtung der Bäume:

“The Imam is a guardian and he is responsible for his subjects” (reported by Al-Bukhari from ‘Abd Allah (swt) b. Umar), and supervising the general agricultural affairs is part of managing the affairs, which is why it is part of the obligation of management upon the Imam. However, the State does not undertake the agricultural affairs directly, because the Messenger (pbuh) left it to the Muslims; he said in the narration regarding the pollination of the trees:

. » أَنْ تُمْ أَعْلَمُ بِأُمُورِ دُنْ يَاكُمْ «.

. » أَنْ تُمْ أَعْلَمُ بِأُمُورِ دُنْ يَاكُمْ «.

„Ihr habt bessere Kenntnis (einer praktischen Fertigkeit) in den Angelegenheiten eurer Welt.“ (überliefert von Muslim von Aischa (ra) und Anas. Ibn Hazm hat es in Al-Ihkam mit seiner eigenen Überlieferungskette berichtet und Aischa (ra) und Anas als Gewährsleute bestätigt, dass der Prophet ﷺ sagte: „أَنْتُمْ أَعْلَمُ بِأُمُورِ دُنْيَاكُمْ“.)

“You have better knowledge (of a technical skill) in the affairs of the world.” (reported by Muslim from Aisha(ra) and Anas. Ibn Hazm reported it in Al-Ihkam with his own chain and authenticated to Aisha(ra) and Anas that the Prophet (saw) said: .» أَنْ تُمْ أَعْلَمُ بِأُمُورِ دُنْ يَاكُمْ «.

„Ihr kennt euch in den weltlichen Angelegenheiten besser aus.“ In einer anderen Überlieferung von Anas:

“You have better knowledge (of a technical skill) in the affairs of the world”. In another report from Anas:

. مَرَّ بِقَوْمٍ يلَُقِّحُونَ، فَقَالَ: لَوْ لََْ تَفْعَ لُوا لَصَلُحَ. قَالَ: فَخَرَجَ شِيصًا، أَنَّ النَّبَِِّ « » فَمَرَّ بِِِمْ فَقَالَ: مَا لِنَخْلِكُمْ؟ قَالُوا: قُلْتَ كَذَا وَكَذَا، قَالَ: أَنْتُمْ أَعْلَمُ بِأَمْرِ دُنْيَاكُمْ .

. مَرَّ بِقَوْمٍ يلَُقِّحُونَ، فَقَالَ: لَوْ لََْ تَفْعَ لُوا لَصَلُحَ. قَالَ: فَخَرَجَ شِيصًا، أَنَّ النَّبَِِّ « » فَمَرَّ بِِِمْ فَقَالَ: مَا لِنَخْلِكُمْ؟ قَالُوا: قُلْتَ كَذَا وَكَذَا، قَالَ: أَنْتُمْ أَعْلَمُ بِأَمْرِ دُنْيَاكُمْ .

„Der Prophet kam zufällig an Leuten vorbei, die damit beschäftigt waren, Bäume zu veredeln. Daraufhin sagte er: Wenn ihr es nicht tätet, wäre es vielleicht gut für euch. (Also gaben sie diese Praxis auf) und es kam zu einem Rückgang des Ertrags. Er (der Heilige Prophet ﷺ) kam zufällig an ihnen vorbei (und sagte): Was ist mit euren Bäumen los? Sie sagten: Du hast so und so gesagt. Daraufhin sagte er: Ihr habt bessere Kenntnis (einer fachlichen Fertigkeit) in den Angelegenheiten der Welt.“ Und in dem Bericht bei Ahmad von Anas sagte der Gesandte Allahs ﷺ:

“The Prophet happened to pass by the people who had been busy in grafting the trees. Thereupon he said: If you were not to do it, it might be good for you. (So they abandoned this practice) and there was a decline in the yield. He (the Holy Prophet) happened to pass by them (and said): What has gone wrong with your trees? They said: You said so and so. Thereupon he said: You have better knowledge (of a technical skill) in the affairs of the world”. And in the report with Ahmad from Anas, the Messenger of Allah (pbuh) said:

.» إِذَا كَانَ شَيْءٌ مِنْ أَمْرِ دُنْيَاكُمْ فَأَنْتُمْ أَعْلَمُ بِهِ، فَإِذَا كَانَ مِنْ أَمْرِ دِينِكُمْ فَإِلََِّ «.

.» إِذَا كَانَ شَيْءٌ مِنْ أَمْرِ دُنْيَاكُمْ فَأَنْتُمْ أَعْلَمُ بِهِ، فَإِذَا كَانَ مِنْ أَمْرِ دِينِكُمْ فَإِلََِّ «.

„Wenn es sich um eine Angelegenheit aus euren weltlichen Dingen handelt, dann kennt ihr euch darin besser aus, und wenn es sich um eine Angelegenheit der Religion handelt, dann kommt zu mir.“ Dies deutet darauf hin, dass der Staat die Landwirtschaft nicht unmittelbar überwacht und sie auch nicht selbst betreibt, sondern eine allgemeine Aufsicht ausübt, indem er das Erlaubte gemäß den verschiedenen Verfahren ordnet, die ausgewählt werden, um die Landwirtschaft zu steigern und zu stärken, sie erleichtert, um etwaige Schwierigkeiten zu beheben, und indem er eine landwirtschaftliche Politik plant, die zur Anhebung der Produktionsniveaus führt.

“If it is something from your worldly affairs, then you are more knowledgeable about it, and if it is from the issues of the Deen, then come to me”. This indicates that the State does not directly supervise the agriculture, nor undertake it, but rather undertakes general supervision by organising what is permitted according to the various styles which are selected in order to increase and strengthen the agriculture, facilitating it to ease any issues, as well as planning an agricultural policy which would lead to raising the production levels.
