The opinion of Al Hasan Al Basriy in relation to AlQiyaas and the Nusoos (texts)
1) Se o Qiyaas se basear em um texto Qat'iy e a 'Illah do texto for estabelecida de forma Saraahatan ou Dalaalatan (explícita ou implícita), neste caso o Qiyaas terá precedência sobre o Khabar Al-Aahaad Azh-Zhanniy. 2) Se o Qiyaas dependeu de um Asl (origem) Zhanniy e a 'Illah foi estabelecida por meio de Istinbaat (dedução), neste caso o Khabar Al-Aahaad tem precedência sobre o Qiyaas.
1) If the Qiyaas is based upon a Qat’iy text and the ‘Illah of the text is Saraahatan or Dalaalatan (explicit or implicit) then in this case the Qiyaas will take precedence over the Khabar Al-Aahaad AzhZhanniy. 2) If the Qiyaas depended upon a Zhanniy Asl (origin) and the ‘Illah was established through Istinbaat (deduction), then in this case the Khabar Al-Aahaad takes precedence over the Qiyaas.
3) Quanto à situação em que o Qiyaas está estabelecido por um texto Zhanniy e a ‘Illah do texto é Zhanniy: na situação em que ocorre um conflito ou contradição entre um Khabar Al-Aahaad e o Al-Qiyaas, e não é possível dar preferência a um sobre o outro, então, de acordo com a sua opinião, os ‘Ulamaa chegaram a um consenso em dar precedência ao Khabar Al-Aahaad sobre o Qiyaas.
3) In regards to when the Qiyaas is established by a Zhanniy text and the ‘Illah of the text is Zhanniy: In the situation when a conflict or contradiction happens between a Khabar Al-Aahaad and Al-Qiyaas and it is not possible to outweigh one over the other, then, in accordance to his view, the ‘Ulamaa have held a consensus upon giving precedence to the Khabar Al-Aahaad over the Qiyaas.
4) Quando a ‘Illah é Mustanbatah (deduzida) e o Asl (origem) sobre o qual o Qiyaas se baseia é Qat’iy. Neste caso, houve divergência de opinião entre os ‘Ulamaa quanto à precedência do Qiyaas sobre o Khabar Al-Aahaad.
4) When the ‘Illah is Mustanbatah (deduced) and the Asl (origin) that the Qiyaas is based upon is Qat’iy. In this case a difference of opinion has taken place amongst the ‘Ulamaa in respect to outweighing the Qiyaas over the Khabar Al-Aahaad.
- Al-Shaatibiy disse, a respeito de se deparar com um conflito entre o Qat'iy e o Zhanniy: "O Zhanniy que conflita com o Asl Qat'iy e não é sustentado pelo Asl Qat'iy é rejeitado sem qualquer problema".
- As-Shaatibiy said in respect to being presented with a conflict between the Qat’iy and the Zhanniy: “The Zhanniy that conflicts with the Qat’iy Asl and is not supported by the Asl Qat’iy is rejected without any problem”.
