আল-ফিকহের অর্থ:
The meaning of Al-Fiqh:
আল-ফিকহ আভিধানিক অর্থে: 'আল-ফাহম' (বোঝা, উপলব্ধি)। আল্লাহ তাআলা মূসা (আঃ)-এর জবানিতে বলেছেন:
Al-Fiqh linguistically means: ‘Al-Fahm’ (understanding). Allah Ta’Aalaa said upon the tongue of Mousaa (as):
এবং আমার জিহ্বার জড়তা খুলে দাও, যাতে তারা আমার কথা বুঝতে পারে (ফিকহ)।
And untie the knot from my tongue (so that) they understand (Fiqh) my speech (TaHa 28).
সেই অর্থে তারা আমি যা বলি তা "বুঝতে" পারে।
Which means that they ‘understand’ what I say to them.
উসুলুল ফিকহের আলেমগণের ইস্তিলাহ (পারিভাষিক সংজ্ঞা) অনুযায়ী "আল-ফিকহ" শব্দের অর্থ হলো:
The meaning of Al-Fiqh in accordance to the Istilaah (terminological definition) of the ‘Ulamaa of Usool ul-Fiqh is:
এটি হলো ‘ইলম (জ্ঞান) যা শরঈ আহকামের ব্যবহারিক বিধানসমূহ তার বিস্তারিত দলিলসমূহ থেকে গ্রহণ করা হয়।
‘It is the ‘Ilm (knowledge) of the practical Ahkaam Ash-Shar’iyah taken from its detailed evidences’.
ব্যাখ্যা (সংজ্ঞার)।
Explanation of the definition:
আল-আহকাম আশ-শার'ঈয়্যাহ:
Al-Ahkaam Ash-Shar’iyah:
এর দ্বারা যা বোঝানো হয়েছে: আল-ওয়াজিব, আল-মান্দূব, আল-মুবাহ, আল-মাকরূহ এবং আল-হারাম।
What is intended by this is: Al-Waajib, Al-Mandoob, Al-Mubaah, Al-Makrooh and Al-Haraam.
উদ্দেশ্যও হলো: আস-সাবাব, আশ-শর্ত, আল-মানি', আল-আযীমাহ, আর-রুখসাহ এবং আস-সিহহাহ, আল-ফাসাদ ও আল-বুতলান।
What is intended is also: As-Sabab, Ash-Shart, Al-Maani’, Al- ‘Azeemah, Ar-Rukhsah and As-Sihhah, Al-Fasaad and Al-Butlaan.
আল-আমালিয়্যাহ (ব্যবহারিক):
Al-‘Amaliyyah (practical):
যা বান্দাদের (দাসদের) কর্মের সাথে সম্পর্কিত, যেমন সালাত, জিহাদ, ব্যবসা-বাণিজ্য এবং মুসলিমদের জন্য একজন খলীফা নিযুক্ত করা।
That which has a relationship to the actions of the ‘Ibaad (slaves) like the Salaah, the Jihaad, the trade and appointing a Khalifah for the Muslims.
আল-মুস্তাফাদাহ:
Al-Mustafaadah:
যা ইস্তিম্বাত (নির্গমন/যুক্তিসিদ্ধ উদ্ভাবন) ছাড়া গ্রহণ করা হয়, এবং যা ইস্তিম্বাতের মাধ্যমে গ্রহণ করা হয়।
That which is taken without Istinbaat (deduction) and that which is taken by way of Istinbaat.
আল-আদিল্লাহ আত-তাফসীলিয়াহ (বিস্তারিত দলিলসমূহ):
Al-Adillah At-Tafseeliyah (the detailed evidences):
এগুলো হলো আল-আদিল্লাহ আল-জুযইয়্যাহ (আংশিক দলিল), যেমন আয়াত বা হাদীস, অথবা উভয়ের কোনো অংশ, যেমন: "আকীমু-স-সালাহ" (সালাত কায়েম করো) এবং যেমন: "আল্লাহ বাই' (ব্যবসা) হালাল করেছেন"।
These are the Adillah Al-Juz’iyah (partial evidences) like the Aayah or the Hadeeth or a part from them both like: “Aqeemu-s-Salaah” (establish the prayer) and like: “Allah has made Bai’ (trade) Halaal”.
