১ – যে মাসলাহাহ (কল্যাণ) শরী‘আতের পক্ষ থেকে কোনো নির্দিষ্ট (খাস্‌স) দলীল দ্বারা সমর্থিত নয়, তা এক ধরনের স্বাদ-আহ্লাদ ও প্রবৃত্তির চাহিদা। আল-গাযালী বলেছেন: “আমরা নিশ্চিতভাবে (কাত‘ঈ) জানি যে, একজন আলিম শরী‘আতের দলীলসমূহের ইঙ্গিতের প্রতি দৃষ্টি না দিয়ে নিজের প্রবৃত্তি ও আকাঙ্ক্ষার ভিত্তিতে বিচার করবেন না। শরী‘আতের দলীলসমূহের দিকে না তাকিয়ে আল-ইস্তিহসান (সূক্ষ্ম বিবেচনা) কেবল প্রবৃত্তির দ্বারা রায় দেওয়ার শামিল।” আর আল-মাসালিহ আল-মুরসালাহ (নির্দিষ্ট দলীলবিহীন কল্যাণ) সম্পর্কে তিনি বলেছেন: “আর যদি শারি‘ (আল্লাহ) এর পক্ষে দলীল প্রদান করে থাকেন, তবে তা ইস্তিহসানের মতো।”

1 – The Maslahah that does not have a specific (Khaass) Daleel for it from the Shar’a represents a kind of relish and desire. Al-Ghazaaliy said: “We know definitely (Qat’an) that the ‘Aalim should not judge by his desire and appetite without paying regard to the indications of the Adillah (evidences). Al-Istihsaan without looking into the Adilllah of the Shar’a represents passing a judgement by the desire alone (or purely)” and in respect to Al-Masaalih Al-Mursalah he said: “And if the Shaari’ does provided evidence for it then it is like the Istihsaan”.
