1 – No está permitido que el mujtahid siga las rukhas dentro de los madhāhib, y ello se debe a que es capaz de dar preferencia a la opinión que considera correcta. Está obligado a seguir aquello que cree más probable (ghalab ʿalā ẓannihi) que sea el ṣawāb (la postura correcta), mientras que no le es lícito seguir otra cosa. Esto, con la excepción de las circunstancias o casos específicos que hemos mencionado anteriormente en relación con el cambio del ijtihād.

1 – It is not permitted for the Mujtahid to follow the Rukhas within the Madhaahib and that is because he is capable of outweighing the opinion that he views to be correct. He is bound to follow that which he believes most likely (Ghalab ‘Alaa Zhannihi) to be the Sawaab (correct view) whilst it is not permissible for him to follow other than that. That is with the exception of the specific circumstances or cases that we have previously mentioned in relation to the changing of the Ijtihaad.

2 – Si la acción del Muqallid al-Mutabbi’, que adopta el Hukm junto con su Daleel, se ha vinculado a un Hukm de una Mas’alah, es decir, si ha realizado la acción basándose en un Hukm específico, no le es lícito abandonar este Hukm salvo por una preponderancia legislativa (Shar’iy), como la fuerza de la evidencia o el nivel de conocimiento del Mujtahid.
