The opinion of Al Hasan Al Basriy in relation to AlQiyaas and the Nusoos (texts)
1) Si el Qiyaas se basa en un texto Qat'iy y la 'Illah del texto es Saraahatan o Dalaalatan (explícita o implícitamente), entonces en este caso el Qiyaas tendrá prioridad sobre el Khabar Al-Aahaad Azhzhanniy. 2) Si el Qiyaas dependía de un Asl (origen) Zhanniy y la 'Illah se estableció mediante Istinbaat (deducción), entonces en este caso el Khabar Al-Aahaad tiene prioridad sobre el Qiyaas.
1) If the Qiyaas is based upon a Qat’iy text and the ‘Illah of the text is Saraahatan or Dalaalatan (explicit or implicit) then in this case the Qiyaas will take precedence over the Khabar Al-Aahaad AzhZhanniy. 2) If the Qiyaas depended upon a Zhanniy Asl (origin) and the ‘Illah was established through Istinbaat (deduction), then in this case the Khabar Al-Aahaad takes precedence over the Qiyaas.
3) En cuanto al caso en que el Qiyaas está establecido por un texto Zhanniy y la 'Illah del texto es Zhanniy: En la situación en que surge un conflicto o contradicción entre un Khabar Al-Aahaad y el Al-Qiyaas, y no es posible dar preferencia a uno sobre el otro, entonces, conforme a su postura, los 'Ulamaa han alcanzado un consenso en dar precedencia al Khabar Al-Aahaad sobre el Qiyaas.
