अल-उर्फ़ और अल-इस्तिस्हाब
Al-‘urf And Al-istishaab
पहला: अल-उर्फ़ (रिवाज)
Firstly: Al-’Urf (custom):
1 – इसकी परिभाषा और इसका महत्व।
1 – Its definition and its importance.
2 – वह 'उर्फ़ (प्रथा) जो हुज्जत (प्रमाण) मानी जाती है, उसके प्रमाण, उसके बारे में उलेमा की राय, और उसकी शर्तें (शुरूत)।
2 – The (type of) ‘Urf that is considered to be a Hujjah and its evidences, the opinions of the ‘Ulamaa in respect to it and its Shuroot (conditions).
3 – अल-'उर्फ़ की श्रेणियाँ (अक़्साम) और अल-'उर्फ़ के प्रयोग के उदाहरण।
3 – The categories (Aqsaam) of Al-‘Urf and examples of the application of Al-‘Urf.
4 – मानव-निर्मित कानूनों के स्रोत के रूप में अल-'उर्फ़
4 – Al-‘Urf as a source for man-made laws.
दूसरा: अल-इस्तिस्हाब (हुक्म की निरंतरता):
Secondly: Al-Istishaab (continuity of the rule):
1 – इसकी परिभाषा, इसकी हुज्जियत (प्रमाणिकता), इसपर अमल करने के प्रमाण और इसके संबंध में उलमा की रायें।
1 – Its definition, its Hujjiyah, the evidences for working with it and the opinions of the ‘Ulamaa in respect to it.
2 – वे अहकाम जो अल-इस्तिस्हाब पर आधारित (या उस पर निर्मित) हैं, और उसके उदाहरण।
2 – The Ahkaam that are built (or based) upon Al-Istishaab and examples of that.
3 - अल-इस्तिस्हाब और मनुष्य-निर्मित कानून।
