अल-इस्तिहसान की श्रेणियाँ: - अल-वाधिह फ़ी उसूल अल-फ़िक़्ह | Quran Course

यह तब होता है जब किसी मजबूरी (ज़रूरत) या किसी मसलहत (हित) के कारण, जो आवश्यकता (हाजत) को पूरा करने या हरज (कठिनाई) को दूर करने के लिए ज़रूरी हो, क़ियास के हुक्म के विरुद्ध जाना पड़ता है।

This is when the Hukm of Qiyaas is gone against due to a compelling Daroorah (necessity) or a Maslahah (interest) required to meet the need (Haajjah) or repel the Haraj (hard or difficult matter).

शरीयत ने स्पष्ट किया है कि किराए पर लिया गया व्यक्ति, यदि उसके पास सौंपी गई किसी चीज़ को अनजाने में, और किसी कोताही के कारण नहीं, नुकसान पहुँचाता है, तो वह ज़िम्मेदार नहीं होता। उदाहरण के लिए, यदि किसी व्यक्ति को एक सप्ताह की अवधि के लिए दूसरे के कपड़े सिलने के लिए काम पर रखा जाए, तो वह अजीर ख़ास (निजी रूप से किराए पर लिया गया व्यक्ति) होता है। यदि वह फिर अपने हाथ से, बिना जानबूझकर, कपड़े को नुकसान पहुँचा दे, तो वह ज़िम्मेदार नहीं है, क्योंकि उसका हाथ अमानत (धरोहर) की हैसियत रखता है, और अल्लाह के रसूल ﷺ ने फ़रमाया:

The Shar’a has explained that the hired person is not liable if he damages something that he has been given in his possession unintentionally and not due to a shortcoming. So if a person is hired to sew a garment for someone else for a period of a week then he is an Ajeer Khaass (private hired person). If he then damages the garment by his hand without it being deliberate he is not liable because his hand represents an Amaanah (trust) and the Messenger of Allah (saw) said:

और यदि किसी दूसरे व्यक्ति को कपड़ा सिलने के लिए किराए पर लिया गया, और वह ऐसा व्यक्ति था जो सभी लोगों के कपड़े सिलता था, तो वह अजीर आम (सार्वजनिक रूप से किराए पर लिया गया व्यक्ति) होगा। फिर यदि उसके हाथ में मौजूद किसी कपड़े को वह नुकसान पहुँचा दे, तो उस पर कोई ज़मान (दायित्व) नहीं होगा, और इसका कारण यह है कि उसका हाथ भी अमानत का हाथ है, जिसे सौंपा गया है। और यह पहले बताए गए अजीर ख़ास के समान है।

And if another person was hired to sew a garment and he was somebody who would sew items of clothing for all of the people then he would be an Ajeer ‘Aamm (public hired person). Then if he was to damage an item of clothing that was in his hand then there would be know Damaan (liability) and that is because his hand is also a hand of Amaanah (i.e. that has been entrusted) and this is in analogy to the Ajeer Al-Khaass mentioned previously.

हालाँकि, इस्तिहसान (इस्तिहसान अल-मस्लहा) के अनुसार निजी रूप से काम पर रखा गया व्यक्ति ज़िम्मेदार नहीं ठहराया जाता, जबकि सार्वजनिक रूप से काम पर रखा गया व्यक्ति ज़िम्मेदार ठहराया जाता है, और यह इसलिए है ताकि वह ऐसा कोई काम स्वीकार न करे या अपने ऊपर न ले जो उसकी क्षमता या सामर्थ्य से बाहर हो।

However, in accordance to Istihsaan (Istihsaan Al-Maslahah) the private hired person is not liable whilst the public hired person is liable and that is so that he does not accept or take on work that is beyond his capability or capacity.

इस्तिहसान अल-मस्लहा ने दरूरत और मस्लहत का ख़याल रखने की वजह से क़ियास द्वारा स्थापित हुक्म से हटकर फ़ैसला किया है, जबकि उसे इसका हुक्म दिया गया था कि नतीजा जो भी हो, हुक्म-ए-शरई का पालन करे।

The Istihsaan Al-Maslahah has gone against the established Hukm by Qiyaas due to regard being given to Daroorah and Maslahah. This is despite having been commanded to follow the Hukm Ash-Shar’iy irrespective of what the results may be.
