अन-नस्ख़ (निरस्तीकरण) के प्रकार
Types of An-Naskh (Abrogation)
1 – बिना प्रतिस्थापन या बदले के हुक्म का नस्ख़ (निरसन):
1 – The Naskh (abrogation) of the Hukm without replacement or substitution:
अल्लाह तआला ने फ़रमाया:
Allah Ta’Aalaa said:
हे ईमान वालो, जब तुम रसूल ﷺ से एकांत में बात करना चाहो तो अपनी बातचीत से पहले कुछ सदक़ा दे दिया करो।
O you who have believed, when you [wish to] privately consult the Messenger, present a charity before your consultation (Al-Mujaadilah 12).
यह हुक्म, जो रसूलुल्लाह ﷺ से एकांत में मशविरा करने से पहले सदक़ा पेश करने का था, उसके बाद आने वाली इस आयत से मंसूख़ (निरस्त) कर दिया गया।
This Hukm, which was the presentation of Sadaqah before meeting the Messenger for private consultation, was abrogated by the following Aayah:
क्या तुम इस बात से डरते हो कि अपने निजी परामर्श (उससे) से पहले दान देना पड़ेगा? अगर तुमने ऐसा नहीं किया और अल्लाह ने तुम्हें माफ़ कर दिया, तो (कम से कम) नमाज़ क़ायम करो, ज़कात दो, और अल्लाह और उसके रसूल ﷺ की आज्ञा मानो। और अल्लाह जानता है जो कुछ तुम करते हो। (अल-मुजादला 13)
Are you afraid of spending in charity before your private consultation (with him)? If then you do it not, and Allah has forgiven you, then (at least) perform As Salat and give Zakat and obey Allah and his Messenger. And Allah is All Aware of what you do (Al-Mujaadilah 13
2 – हुक्म के नस्ख़ (निरस्तीकरण) का एक ऐसे नए हुक्म की ओर होना जो उससे हल्का हो:
2 – The Naskh (abrogation) of the Hukm to a (new) Hukm that is lighter than it:
मंसूख़ (निरस्त) हुक्म: युद्ध के समय दस दुश्मनों के सामने डटे रहना एक (मुसलमान) के लिए। अल्लाह तआला ने फ़रमाया:
The Mansookh (abrogated) Hukm: One (of the Muslims) standing firm in the face of ten enemies when fighting. Allah Ta’Aalaa said:
यदि तुम में बीस धैर्यवान हों तो वे दो सौ पर विजय पाएँगे। (अल-अनफ़ाल 65)
If there are twenty steadfast from you then you will overcome two hundred (Al Anfaal 65)
नासिख़ (निरस्त करने वाला) हुक्म: युद्ध के दौरान दो दुश्मनों के सामने डटे रहने वाले मुसलमानों में से एक। अल्लाह तआला ने फ़रमाया:
The Naasikh (abrogating) Hukm: One of the Muslims standing firm in the face of two enemies when engaged in battle. Allah Ta’Aalaa said:
अब अल्लाह ने तुम पर से (यह बोझ) हल्का कर दिया है, और उसने जान लिया है कि तुम में कमज़ोरी है। अतः यदि तुम में से सौ लोग धैर्यवान हों तो वे दो सौ पर विजय पाएँगे। (अल-अनफ़ाल 66)
Now Allah has lightened for you and He has known that there is weakness amongst you. So if there are one hundred from you who are steadfast they will overcome two hundred (Al-Anfaal 66).
3 – एक हुक्म का उसी जैसे दूसरे हुक्म द्वारा नस्ख़: मंसूख़ (निरस्त) हुक्म: अल्लाह के रसूल ﷺ के आदेश से नमाज़ में अल-क़ुद्स (बैतुल मक़दिस) की ओर मुँह करना।
3 – The Naskh of a Hukm to a Hukm that is comparable to it: The Mansookh (abrogated Hukm): Directing the prayer in the direction of Al-Quds due to the command of the Messenger of Allah (saw).
नासिख़ (निरस्त करने वाला) हुक्म: नमाज़ में क़िबले की ओर रुख़ करना, काबा की ओर।
The Naasikh (abrogating) Hukm: Directing the prayer towards the Ka’bah.
अल्लाह तआला ने फ़रमाया:
Allah Ta’Aalaa said:
हमने निश्चित रूप से आपके आकाश की ओर चेहरा फेरने को देखा है, [ऐ मुहम्मद], और हम अवश्य आपको एक ऐसे क़िबले की ओर फेर देंगे जिससे आप प्रसन्न होंगे। अतः अपना चेहरा मस्जिद अल-हराम की ओर फेर लीजिए। और तुम [ईमान वाले] जहाँ कहीं भी हो, नमाज़ में अपने चेहरे उसी की ओर फेरो।
We have certainly seen the turning of your face, [O Muhammad], toward the heaven, and We will surely turn you to a Qiblah with which you will be pleased. So turn your face toward al-Masjid al-Haram. And wherever you [believers] are, turn your faces toward it [in prayer] (Al-Baqarah 144).
4 - एक कठोर हुक्म द्वारा हुक्म का नस्ख़ (निरसन):
4 - The Naskh of a Hukm to a Hukm that is more severe:
मंसूख़ (निरस्त) हुक्म: ज़ानी को डांटना और उन्हें घर में नज़रबंद रखना, जैसा कि अल्लाह तआला के इस कौल से लिया गया है:
The Mansookh (abrogated) Hukm: Reprimanding the Zaani and confining them to house arrest as taken from His Qawl Ta’Aalaa:
जो तुम्हारी स्त्रियों में से व्यभिचार करें, उन पर अपनों में से चार गवाह लाओ। फिर यदि वे गवाही दे दें, तो उन स्त्रियों को घरों में बंद रखो यहाँ तक कि मृत्यु उन्हें उठा ले, या अल्लाह उनके लिए कोई और राह बना दे। और तुम में से जो दो व्यक्ति यह कर्म करें, उन दोनों को दंड दो। फिर यदि वे तौबा कर लें और सुधर जाएँ, तो उन्हें छोड़ दो। निश्चय ही अल्लाह बड़ा तौबा स्वीकार करने वाला, अत्यंत दयावान है। (अन-निसा 15-16)
Those who commit unlawful sexual intercourse of your women - bring against them four [witnesses] from among you. And if they testify, confine the guilty women to houses until death takes them or Allah ordains for them [another] way. And the two who commit it among you, punish them both. But if they repent and correct themselves, leave them alone. Indeed, Allah is ever Accepting of repentance and Merciful (An-Nisaa’ 15-16).
नासिख़ (निरस्त करने वाला) हुक्म: ग़ैर-मुहसन (जो शादीशुदा न हो) को सौ कोड़े मारना, जो अल्लाह तआला के इस क़ौल से लिया गया है:
The Naasikh (abrogating) Hukm: Lashing the non-Muhsin (married) with one hundred lashes which is taken from the Qawl of Allah Ta’Aalaa:
[अविवाहित] स्त्री या [अविवाहित] पुरुष, जो व्यभिचार का दोषी पाया जाए - उनमें से हर एक को सौ कोड़े मारो, और उनके प्रति किसी दया के कारण तुम्हें अल्लाह के निर्धारित किए हुए मामले में ढिलाई न करने दो (अन-नूर 2)।
The [unmarried] woman or [unmarried] man found guilty of sexual intercourse - lash each one of them with a hundred lashes, and let not any pity for them restrain you in regard to a matter prescribed by Allah (An-Noor 2).
