सीगत उन-नहि (निषेध का स्वरूप)
Seeghat Un-nahi (the Forbiddance Form)
The Nahi (forbiddance) has a Seeghah (form) in the Arabic language and it is: لآ تَفْعَل or لا يَفْعَل and it means to leave or not do the action ‘Alaa Wajh -il-Isti’laa’ (upon the basis that it has come from a higher authority). There are Siyagh (forms) in accordance to the styles of the Arabic speech that establish the leaving or refraining from the action and the meaning of the Nahi can be deduced from the composition of the sentences. It is possible to sum up the forms of the Nahi as follows:
1- फ़ॉर्म لآ تَفْعَلْ या لا يَفْعلَ: यह अल्लाह तआला के इस कथन जैसा है:
1- The form لآ تَفْعَلْ or لا يَفْعلَ This is like the Qawl of Allah Ta’Aalaa:
और उस प्राण को हत्या न करो जिसे अल्लाह ने हराम ठहराया है, सिवाय सत्य के आधार पर।
And do not kill the soul (human life) which Allah has forbidden [to be killed] except by [legal] right (Al-An’aam 151).
2 – लफ़्ज़ حَرَّمَ (हर्रama) और उसके मुश्तक़ात। यह उसी तरह है जैसे अल्लाह (सुब्हानहू व तआला) का क़ौल है:
2 – The Lafzh حَرَّمَ ( Harrama) and its derivations (Mushtaqaat). This is like the Qawl of Allah (swt):
{तुम्हारे लिए हराम किए गए हैं मुर्दार, खून, सूअर का गोश्त, और वह जिस पर अल्लाह के सिवा किसी और के नाम की नियाज़ दी गई हो} (अल-माइदा 3)
Prohibited to you are dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah (Al-Maa’idah 3).
3 – लफ़्ज़ 'نَهَى' (मना करना) और उसके मुश्तक़ात (व्युत्पन्न रूप)। यह अल्लाह के इस क़ौल (कथन) की तरह है:
3 – The Lafzh ' نَهَئ' (to forbid) and its Mushtaqaat (derivations). This is like in His Qawl (swt):
और वह अश्लीलता, बुरे आचरण और अत्याचार से रोकता है (अन-नह्ल 90)।
And forbids immorality and bad conduct and oppression (An-Nahl 90).
4 – चेतावनी के शब्द-प्रयोग (अलफ़ाज़ अत-तहज़ीर), जैसे: ‘إياك’ (इय्याका)। जैसा कि अल्लाह के रसूल ﷺ की इस हदीस में है:
4 – Alfaazh At-Tahdheer (worded expressions of warning) like: ‘إياك‘ This is like in the Hadeeth of the Messenger of Allah (saw):
नमाज़ में इधर-उधर मुड़ने से सावधान रहो
Beware of turning in the Salaah
5 – लफ़्ज़ (शब्द) 'لا يَحِلَّ' (यह हलाल नहीं है)।
5 – The Lafzh (wording) ‘لا يَحِلَّ ‘It is not Halaal).
यह उनके कथन जैसा है (saw): Note: the original says "(saw)" after "his statement", referring to the Prophet, so ﷺ should follow the mention of the Prophet. Here "his" refers to the Prophet but no explicit name appears; the abbreviation "(saw)" is kept as in the rules? The rules say instead of written-out or abbreviated honorific, write ﷺ once after each mention of the Prophet. So the correct output: यह उनके कथन जैसा है ﷺ
This is like his statement (saw):
गायिकाओं (अल-मुग़न्नियात) को बेचना, ख़रीदना या उनका व्यापार करना हलाल नहीं है, और उनकी क़ीमत का उपभोग हराम है (इब्न माजह, अपनी सुनन में, किताबुत तिजारात में)।
It is not Halaal to sell Al-Mughanniyaat (female singers), or purchase them, or trade in them, and the consumption of their price is Haraam (Ibn Maajah in his Sunan in the Book of Tijaaraat).
All of the above forms establish the Nahi (forbiddance) and even if most of them have not been provided in origin by the language to indicate the Nahi. The Nahi in them is established by the linguistic formation and composition of the sentence and what they indicate in terms of the meaning of the Nahi. That is because the only form that has been set and provided by the Arabic language for the Nahi is that of the Mudaari’ (present verb) form that is connected to the ‘Laa An-Naahiyah’ (لا) (the ‘Laa’ of forbidding).
