शरीयत के मान्य नस्ख़ (निरस्तीकरण) की शुरूत (शर्तें)
The Shuroot (conditions) of the valid Shar’iy Naskh
नस्ख़ (निरस्तीकरण) के मान्य होने के लिए यह आवश्यक है कि निम्नलिखित चार शर्तें पूरी हों और उन पर अमल हो।
It is necessary for the following four conditions to be fulfilled and met in order for the Naskh to be valid:
1 – यह कि दलीलु अन-नासिख (रद्द करने वाली दलील) और दलीलु अल-मंसूख (रद्द की गई दलील), दोनों शरई दलीलें हैं।
1 – That the Daleel An-Naasikh (abrogating evidence) and the Daleel Al-Mansookh (abrogated evidence) are both Shar’iy evidences.
2 – यह कि नासिख़ (रद्द करने वाला हुक्म) मंसूख़ (रद्द किए गए हुक्म) के बाद और उसके बाद में उतरा हो।
2 – That the Naasikh was revealed later than and after the Mansookh.
3 – यह कि नासिख़ (रद्द करने वाला हुक्म) मंसूख़ (रद्द किए गए हुक्म) के समान हो (अपनी शक्ति और महत्व में) या उससे अधिक शक्तिशाली हो।
3 – That the Naasikh is like the Mansookh (in strength and weight) or stronger than it.
4 – इस बात का कि नासिख़ दलील (Daleel AnNaasikh) के मंसूख़ दलील (Daleel Al-Mansookh) को निरस्त करने पर कोई शरई हुज्जत (Hujjah Shar'iyah) मौजूद है।
4 – That there is a Hujjah Shar’iyah indicating that the Daleel AnNaasikh is abrogating the Daleel Al-Mansookh.
