العرف اور الاستصحاب
Al-‘urf And Al-istishaab
اولاً: العُرف (رواج):
Firstly: Al-’Urf (custom):
1 – اس کی تعریف اور اس کی اہمیت۔
1 – Its definition and its importance.
2 – وہ (قسم کا) عرف جسے حجت تسلیم کیا جاتا ہے اور اس کے دلائل، اس کے بارے میں علماء کی آراء اور اس کی شروط۔
2 – The (type of) ‘Urf that is considered to be a Hujjah and its evidences, the opinions of the ‘Ulamaa in respect to it and its Shuroot (conditions).
3 – عرف کی اقسام اور عرف کے اطلاق کی مثالیں۔
3 – The categories (Aqsaam) of Al-‘Urf and examples of the application of Al-‘Urf.
4 – انسانی وضع کردہ قوانین کے ایک ماخذ کے طور پر عرف۔
4 – Al-‘Urf as a source for man-made laws.
دوسری چیز: الاستصحاب (حکم کا تسلسل):
Secondly: Al-Istishaab (continuity of the rule):
1 – اس کی تعریف، اس کی حجیت، اس پر عمل کرنے کے دلائل اور اس کے متعلق علماء کی آراء۔
1 – Its definition, its Hujjiyah, the evidences for working with it and the opinions of the ‘Ulamaa in respect to it.
2 – وہ احکام جو الاستصحاب پر مبنی ہیں اور اس کی مثالیں۔
2 – The Ahkaam that are built (or based) upon Al-Istishaab and examples of that.
3 - الاستصحاب اور انسانی وضع کردہ قوانین۔
3 -Al-Istishaab and man-made laws.
