The Stages That The Human Passes Through In Respect To Al-ahliyah
1 - Die Fötalphase: Für den Fötus im Mutterleib wird eine unvollständige Ahliyah (Rechtsfähigkeit) begründet, weshalb ihm Rechte zukommen, die keiner Annahme (Qabool) bedürfen, um bestätigt zu werden. Dazu gehören das Meeraath (Erbrecht) und die Wasiyah (Vermächtnis). Was dagegen Huqooq (Rechte) betrifft, die eine Annahme (Qabool) erfordern, wie etwa der Empfang von Geschenken, so wird dies für den Fötus nicht begründet. Auch die Ahliyah des Adaa’ (Rechtsfähigkeit zur eigenverantwortlichen Ausübung von Pflichten) wird für den Fötus weder begründet noch bestätigt.
1 - The Foetal stage: An incomplete Ahliyah is established for the foetus within the womb of the mother and so rights are established for it that do not require an acceptance (Qabool) for it to be affirmed. This includes the Meeraath (inheritance) and Wasiyah (will). As for the Huqooq (rights) requiring Qabool (an acceptance) like the receiving of gifts, then this is not established for the foetus. The Ahliyah of Adaa’ performance is also not established or affirmed for the foetus.

Dies gilt von der Geburt bis zum Alter der Tamyeez (Unterscheidungsfähigkeit), das sieben Jahre beträgt.
This is from the birth until the age of Tamyeez (discernment) which is seven years of age.
Die vollständige Verpflichtung (al-Wujūb al-Kāmilah) wird beim Kind (Ṣabiy) bejaht, und daher ist es gültig, dass er Rechte erwirbt und Pflichten trägt, die der Walī (Vormund) in seinem Namen erfüllen darf. Dazu gehören die Zakāh, die Ṣadaqat al-Fiṭr und die Haftung für das, was vom Besitz anderer beschädigt wurde.
The Wujoob Kaamilah (complete obligation) is affirmed from the child (Sabiy) and so it is valid for him to attain rights and to carry obligations that are permitted for the Waliy (guardian) to perform on his behalf. This includes the Zakaah, Sadaqat ul-Fitr and the guarantee in respect to what is damaged from the properties of others.

As for the Ahliyah of Al-Adaa; (performance) then this does not exist in his right due to his inability and the shortcoming in respect to his ‘Aql in relation to understanding the Khitaab (address).
3 – Die Stufe des Tamyeez (Unterscheidungsvermögen):
3 – The stage of Tamyeez (discernment):
Dies beginnt mit dem Alter von sieben Jahren und endet mit dem Erreichen der Mündigkeit (Pubertät).
This begins at the age of seven and ends at the age of coming to maturity (puberty).
In dieser Stufe wird ihm die Ahliyah al-Wujoob (Verpflichtungsfähigkeit) zugesprochen, wie sie in der vorherigen Stufe bestätigt wurde.
In this stage the Ahliyah of Al-Wujoob (obligation) is established for him as it was affirmed in the previous stage.
Was die Ahliyyat al-Adaa' (Fähigkeit zur Ausübung) betrifft, so ist sie bei ihm in unvollkommener (naqisah) Weise gegeben, aufgrund seines Mangels in Bezug auf die Erfüllung der Bedingungen der Taklif (rechtlichen Verantwortlichkeit). Folglich wird von ihm nichts verlangt, außer in der Form von Unterweisung, Anleitung und Verhaltensschulung. Dies gleicht dem Befehl an das Kind, das Salah zu verrichten, und der Gewöhnung an das Fasten. Einige seiner Handlungen können angenommen werden, wie seine Annahme von Geschenken (Hadiyah und Hibbah) und Sadaqah. Bei anderem hängt es von der Erlaubnis des Waliy (Vormunds) ab. Erlaubt der Wali es, so ist es gültig, während es ohne seine Erlaubnis ungültig ist. All dies gilt, während er für seine Handlungen nicht zur Rechenschaft gezogen wird, und zwar aufgrund der Aussage des Gesandten Allahs ﷺ im Hadith, der im Themenbereich der Bedingungen der Taklif erwähnt wird.
As for the Ahliyah of performance (Al-Adaa’) then it is established for him in an incomplete (Naaqisah) manner due to his deficiency in respect to fulfilling the conditions of At-Takleef (legal responsibility). Consequently, he is not requested to undertake anything except in a way of teaching, instruction and behavioural refinement. This is like commanding the child to perform the Salaah and getting him used to the fasting. Some of his conducts can be accepted like his acceptance of gifts (Al-Hadiyah and Al-Hibbah) and Sadaqah. In other than this it rests upon the permission of the Waliy (guardian). If the Wali permits it then it is valid whilst it is invalid without him allowing it. All of this is whilst he is not taken to task and held to account for his actions which is due to the Qawl of the Messenger of Allah (saw) in the Hadeeth mentioned in the subject area of the conditions of At-Takleef:
Die Feder wurde von drei Personen angehoben: vom Schlafenden, bis er erwacht, vom Kind, bis es die Pubertät erreicht, und vom Geisteskranken, bis er wieder vernünftig denken und verstehen kann (Abu Dawud).
The pen has been lifted from three: The sleeping person until he awakens, the boy until he reaches the age of puberty and the one who has lost his mind until he can rationally reason/understand again (Abu Daawood).
4 – Die Stufe der Bulūgh (Geschlechtsreife) und des ʿĀqil (Zurechnungsfähigkeit):
4 – The stage of Buloogh (maturity) and ‘Aaqil (of sound mind):
In dieser Phase werden die vollständige Rechtsfähigkeit zur Verpflichtung (Ahliyah Al-Wujoob Al-Kaamilah) und die vollständige Handlungsfähigkeit (Ahliyah Al-Adaa’ Al-Kaamilah) bei ihm festgestellt und bejaht. Folglich würde gegen ihn die festgelegte Strafe (Hadd) vollzogen, wenn er Unzucht (Zinaa) begehen würde, und seine Hand würde abgetrennt, wenn er stehlen würde. Ebenso wären die ‘Uqood (Verträge) und die scharia-gemäßen Rechtsgeschäfte von ihm gültig, und ihre Wirkungen würden aus ihnen hervorgehen.
In this stage the Ahliyah Al-Wujoob Al-Kaamilah and the Ahliyah Al-Adaa’ Al-Kaamilah (complete competency of obligation and complete competence of performance) is established and affirmed in respect to him. Consequently, if he was to commit Zinaa he would have the Hadd (set punishment) applied upon him and if he stole, his hand would be severed. Similarly, the ‘Uqood (contracts) and Shar’iyah transactions would be valid from him and their effects would result from them.
Der Zeitpunkt der Pubertät (Buloogh, das Erreichen der Geschlechtsreife) tritt mit dem Erscheinen eines der Anzeichen der Reife ein. Dazu gehören etwa das Ihtilaam (der Samenerguss), die Menstruation oder das Auftreten von Schamhaar. Die Mehrheit der Fuqahaa hat dieses Alter auf fünfzehn Jahre festgesetzt. Dabei wirken sich Unterschiede im Umfeld sowie die individuelle körperliche Veranlagung der Person darauf aus.
The point of Buloogh (reaching of the age of maturity) would occur through the appearance of one of the signs of maturity. That is like the Ihtilaam (emission of Maniy/seminal discharge), menstruation or the appearance of pubic hair. The majority of the Fuqahaa; have considered this age to be fifteen years of age. In respect to this, differences in the environment and the specific individual configuration or makeup of the person will have an impact upon it.
