1 – アル＝イジュティハードとは、ムジュタヒド（法学的努力を尽くす学者）が、（自らの）努力と能力を注ぎ、その詳細な根拠（典拠）から直接に、実践的なシャリーア上の規定（アフカーム・アッ＝シャル・イーヤ）を導き出す（イスティンバート）ことである。

1 – Al-Ijtihaad is the exerting or expending of the Mujtahid’s effort (and capability) to deduce (Istinbaat) the practical Ahkaam Ash-Shar’iyah from its detailed evidences (directly).

「イフター」(fatwā の発出)とは、ある事柄が実際に起きたかどうかにかかわらず、ムフティー(法学者)がある問題についてのシャリーア上の判断(ハムス・シャルイー)を伝えることを意味する。

As for Al-Iftaa’ (i.e. passing of the Fatwaa) then it means the Mufti informing about the Hukm Ash-Shar’iy for a Mas’alah (issue) whether that issue occurred or not.

2 – ムジュタヒド（イジュティハード〔独自の法的推論〕を行う者）に求められる条件として、ハッサン（法の推論）を行うために必要な、シャリーア（イスラーム法）の諸学問分野と言語学の諸学問分野に精通していることが定められている。
