De Ahliyah is verdeeld in twee categorieën: Ahliyah Wujoob en Ahliyah Adaa’.

The Ahliyah is divided into two categories: Ahliyah Wujoob and Ahliyah Adaa’.

1 – Ahliyah Wujoob: Dit heeft betrekking op de geschiktheid van de mens met betrekking tot het hebben van legitieme rechten of het feit dat er rechten op hem rusten. Deze Ahliyah bestaat vanaf het moment dat de mens een foetus is in de baarmoeder van zijn moeder, daarna als baby, kind en vervolgens als Baaligh (d.w.z. volwassen/puber). Daarom heeft de mens gedurende het leven zelf rechten (Huqooq) en zijn Ahkaam aan hem gerelateerd, zoals de Ahkaam van Al-Irth (erfenis) en Az-Zakaah met betrekking tot zijn bezit, onder andere rechtsregels (Hukm).

1 – Ahliyah Wujoob: This relates to the suitability of the human in respect to him having legitimate rights or rights being due upon him. This Ahliyah exists from the time that the human is a foetus in the womb of his mother, then as a baby, child and then Baaligh (i.e. adult/pubescent) Therefore, through life itself the human has rights (Huqooq) and Ahkaam are related to him like the Ahkaam of Al-Irth (inheritance) and Az-Zakaah in respect to his wealth amongst other rulings.

2 – Ahiyah Al-Adaa’: Dit heeft betrekking op de geschiktheid van de mens met betrekking tot de Takleef in het geval dat hij de verantwoordelijkheid draagt voor zijn daden en spraak. De Shuroot van deze Takleef in het geval dat de Ahliyah (geschiktheid) volledig is met betrekking tot de uitvoering (als geheel) zijn Al-Buloogh (volwassenheid), Al-‘Aql (gezonde geest) en Al-Qudrah (bekwaamheid). Als de Ahliyah gebrekkig of onvolledig is met betrekking tot de Adaa’ (uitvoering), dan heeft dit uitsluitend betrekking op At-Tamyeez (leeftijd van onderscheidingsvermogen) en dit begint wanneer het kind de leeftijd van zeven jaar bereikt en duurt voort tot hij de leeftijd van de puberteit (Al-Buloogh) bereikt.

2 – Ahiyah Al-Adaa’: This relates to the suitability of the human in regards to the Takleef in the case where he carries the responsibility of his actions and speech. The Shuroot of this Takleef in the case where the Ahliyah (suitability) is complete in respect to the performance (as a whole) are Al-Buloogh (adulthood), Al-‘Aql (sound mind) and Al-Qudrah (capability). If the Ahliyah is deficient or incomplete in respect to the Adaa’ (performance) then this relates to At-Tamyeez (age of discernment) alone and this starts when the child reaches the age of seven and lasts until he reaches the age of puberty (Al-Buloogh).
