De mening van Al Hasan Al Basri met betrekking tot AlQiyaas en de Nusoos (teksten)
The opinion of Al Hasan Al Basriy in relation to AlQiyaas and the Nusoos (texts)
1) Als de analogie (Qiyas) is gebaseerd op een Qat’iy tekst en de grondreden (Illah) van de tekst Saraahatan of Dalaalatan (expliciet of impliciet) is, dan krijgt de analogie (Qiyas) in dit geval voorrang op de Khabar Al-Aahaad AzhZhanniy. 2) Als de analogie (Qiyas) afhankelijk is van een Zhanniy Asl (oorsprong) en de grondreden (Illah) is vastgesteld door middel van Istinbaat (deductie), dan krijgt de Khabar Al-Aahaad in dit geval voorrang op de analogie (Qiyas).
1) If the Qiyaas is based upon a Qat’iy text and the ‘Illah of the text is Saraahatan or Dalaalatan (explicit or implicit) then in this case the Qiyaas will take precedence over the Khabar Al-Aahaad AzhZhanniy. 2) If the Qiyaas depended upon a Zhanniy Asl (origin) and the ‘Illah was established through Istinbaat (deduction), then in this case the Khabar Al-Aahaad takes precedence over the Qiyaas.
3) Met betrekking tot wanneer de analogie (Qiyas) wordt vastgesteld op basis van een Zhanniy-tekst en de grondreden (Illah) van de tekst Zhanniy is: In de situatie waarin er een conflict of tegenstrijdigheid ontstaat tussen een Khabar Al-Aahaad en de analogie (Qiyas) en het niet mogelijk is om de een boven de ander te laten prevaleren, dan hebben de geleerden (Ulama) volgens zijn visie consensus bereikt over het geven van voorrang aan de Khabar Al-Aahaad boven de analogie (Qiyas).
3) In regards to when the Qiyaas is established by a Zhanniy text and the ‘Illah of the text is Zhanniy: In the situation when a conflict or contradiction happens between a Khabar Al-Aahaad and Al-Qiyaas and it is not possible to outweigh one over the other, then, in accordance to his view, the ‘Ulamaa have held a consensus upon giving precedence to the Khabar Al-Aahaad over the Qiyaas.
4) Wanneer de grondreden (Illah) Mustanbatah (afgeleid) is en de Asl (oorsprong) waarop de analogie (Qiyas) is gebaseerd Qat’iy is. In dit geval is er een verschil van mening ontstaan onder de geleerden (Ulama) met betrekking tot het zwaarder laten wegen van de analogie (Qiyas) boven de Khabar Al-Aahaad.
4) When the ‘Illah is Mustanbatah (deduced) and the Asl (origin) that the Qiyaas is based upon is Qat’iy. In this case a difference of opinion has taken place amongst the ‘Ulamaa in respect to outweighing the Qiyaas over the Khabar Al-Aahaad.
- As-Shaatibiy zei met betrekking tot het worden geconfronteerd met een conflict tussen het Qat’iy en het Zhanniy: “Het Zhanniy dat in strijd is met de Qat’iy Asl en niet wordt ondersteund door de Qat’iy Asl, wordt zonder enig probleem verworpen”.
- As-Shaatibiy said in respect to being presented with a conflict between the Qat’iy and the Zhanniy: “The Zhanniy that conflicts with the Qat’iy Asl and is not supported by the Asl Qat’iy is rejected without any problem”.
