L'Al-Istishaab est pris en considération (ou accordé du poids) au sein des lois humaines, et cela est manifeste dans les points suivants :

Al-Istishaab is given consideration (or weight) within the man-made laws and this is apparent in the following matters:

1 – Al-Istishaab est pris en considération par rapport au code pénal et il agit comme un Asl (principe de base) en son sein, car les choses demeurent en état de Ibaahah (permission) tant qu'un texte n'est pas apporté pour établir ou prouver la peine. De même, l'accusé est innocent jusqu'à ce qu'une preuve soit apportée pour prouver l'accusation (ou la culpabilité) ou jusqu'à ce qu'un texte soit émis pour la peine. Ces questions sont fondées sur Al-Istishaab et il s'agit d'Istishaab Al-Baraa’ah Al-Asliyah (la continuité de la non-responsabilité originelle).

1 – Al-Istishaab is taken in respect to the penal code and it acts as an Asl (origin) within it because the matters remain upon Ibaahah (permissibility) as long as a text is not brought establishing or proving the punishment. Also, the accused is innocent until an evidence is brought to prove the accusation (or guilt) or until a text is issued for the punishment. These matters are based upon Al-Istishaab and this is Istishaab Al-Baraa’ah Al-Asliyah (The continuance of the original non-liability).
